1. 04-79 91 Lake Shore Drive Public Hearing
Section 64G, Block 4, Lot 118 Zone: R15
Application for: (1) An interpretation of the Zoning Law regarding the Building Inspector's determination that: (a) the referenced application is for construction of a “new single-family residence” requiring area variances under the current Zoning Law and therefore, the applicant cannot proceed with construction under a prior approval for “additions and alterations to an existing single-family residence” that was granted prior to the September 2004 amendments to the Zoning Law and (b) the entire lower level of the proposed residence shall be counted in the gross floor area (GFA) calculations; and/or (2) area variances from the maximum permitted GFA to permit a 6973 square foot residence where a maximum of 4870.9 square feet is permitted, an excess of 2102.1 square feet and to permit the finished floor elevation of the first floor to be 8.41 feet above the average finished grade along the front foundation wall where a maximum of 3 feet is permitted.

Application for: An area variance to permit a 6-foot high fence along a side lot line or within a side yard where a maximum of 4 feet is permitted.
3. 05-17 Omnipoint Communications, Inc., 253 Garth Road Public Hearing
Section 49B, Block 5, Lot 2 Zone: M350
Application for: A special permit and site plan and architectural review approval to permit the installation of a wireless communications facility consisting of 11 small panel antennas and related equipment cabinets on the roof of an existing building.
4. 05-08 73 Johnson Road Public Hearing
Section 55, Block 10, Lot 18 Zone: R5
Application for: Area variances to permit the construction of a rear addition to an existing single-family residence with a right side yard setback of 4.74 feet where a minimum of 8 feet is required, a deficiency of 3.26 feet (the existing residence has a legal nonconforming right side yard setback of 4.74 feet, thus the addition will increase the degree of dimensional nonconformity) and to permit the construction of an open front porch with a setback of 19.37 feet where a minimum of 26 feet is required, a deficiency of 6.63 feet (the existing residence has a legal nonconforming front yard setback of 24.37 feet where a minimum of 30 feet is required; porches are permitted to extend a maximum of 4 feet into the required front yard).
