1. 04-03 83-85-87 Maple Street Public Hearing
Section 63H, Block 1, Lots 21A, 21B, 21C Zone: RB and R6
Application for: An appeal of the Building Inspector's determination regarding: (1) Section 4.B.2. which states, in part: “Except where referenced to a street line or other designated line shown on such map by distance in feet therefrom, the district lines are intended to follow lot lines. . . . In un-subdivided land, or where a district boundary divides a parcel or lot, the location of such boundary, if not indicated by dimensions shown upon such map, shall be determined by the use of the scale appearing thereon. If the district classification of any property is in question, it shall be deemed to be in the most restrictive adjoining district”; and (2) Section 7.A. of the Zoning Law which states: “Where the boundary of a district divides a lot, the Planning Board may, by Special Permit in accordance with Section 11, permit the extension of any lawful conforming use permitted on that portion of the lot lying in the less restricted district, for a distance not to exceed 75 feet measured at right angles from such district boundary provided all other requirements of the more restricted district are met.”

Application for: An area variance from the minimum required lot area to permit a 4816 square foot building lot where a minimum of 5000 square feet is required, a deficiency of 184 square feet or 4 percent.
3. 05-17 Omnipoint Communications, Inc., 253 Garth Road Public Hearing
Section 49B, Block 5, Lot 2 Zone: M350
Application for: A special permit to allow the installation of a wireless communications facility, consisting of 11 panel antennas and related equipment cabinets, on the roof of an existing multi-family residential building. At a Planning Board meeting on May 25, 2005, the application received site plan and architectural review approval subject to review and approval by the Fire Department.

Application for: An area variance to permit a front yard setback of 25 feet where a minimum of 30 feet is required, a deficiency of 5 feet or 17 percent, to allow the construction of a front entry vestibule to an existing single-family residence.
5. 05-03 124 Highland Avenue Public Hearing
Section 73, Block 2, Lots 108 and 109 Zone: R6
Application for: An area variance from the effective square requirement for a proposed new building lot (applicant's preferred plan, Option 1) or, alternately, an area variance from the effective square requirement for the proposed new building lot and an area variance from the side yard setback of the existing residence on the lot to the proposed division line (Option 2) to permit a proposed 2-lot subdivision.

Application for: Area variances: (1) to permit the construction of an open front porch which projects 3.04 feet into the required front yard setback and which extends the entire width of an existing single-family residence where open front porches are permitted to extend a maximum of 4 feet into the front yard setback but they may not extend across more than 30 percent of the width of the residence; and (2) to permit a gross floor area (GFA) of 3270 square feet where a maximum GFA of 3000 square feet is permitted, an excess of 270 square feet or 9 percent, to allow additions to an existing single-family residence.

Section 40, Block 2, Lot 45 Zone: RB and R3
Application for: A special permit to allow the installation of a wireless communications facility, consisting of 6 panel antennas and related equipment on the roof of an existing multi-family residential building. (Preliminary review only, requires referral to the ARB and the Planning Board for site plan and architectural review).
8. 05-53 22 Fairway Drive Public Hearing
Section 63E, Block 4, Lot 36
Application for: An area variance to permit a rear yard setback of 23.5 feet where a minimum of 25 feet is required, a deficiency of 1.5 feet or 6 percent, to allow the construction of a two-story rear addition to an existing single-family residence.
9. 05-55 243 Park Avenue Public Hearing
Section 65C, Block 3, Lot 20 Zone: R6
Application for: An area variance to permit a side yard setback of 7.5 feet where a minimum of 10 feet is required, a deficiency of 2.5 feet or 25 percent, to allow for the construction of an addition to an existing single-family residence.

Section 76, Block 3, Lot 32 Zone: R5
Application for: An area variance to permit a gross floor area (GFA) of 2631 square feet where a maximum GFA of 2425 square feet is permitted, an excess of 206 square feet or 8.5 percent, to allow the construction of a two-story addition to an existing single-family residence.

Section 85, Block 2, Lot 24 Zone: R5
Application for: An area variance to legalize an existing garage with a 2-foot side yard setback where a variance granted in 1983 permitted a 3-foot setback.
12. 05-60 11 Bronson Avenue Public Hearing
Section 63C, Block 1, Lot 5 Zone: R6
Application for: Area variances: (1) to permit a side yard setback of 8.9 feet where a minimum of 10 feet is required, a deficiency of 1.1 feet or 11 percent to allow for the construction of a powder room addition to an existing residence; (2) to permit a gross floor area of 2726 square feet here a maximum of 2650 is permitted an excess of 76 square feet to allow first and second floor additions to the residence; and (3) to permit an increase in the degree of dimensional non-conformity with regard to the building height to allow the first and second floor additions (for zoning compliance purposes the existing residence is considered 3 stories where a maximum of 2.5 stories is permitted).
13. 05-61 41 Vernon Drive Public Hearing
Section 41, Block 5, Lot 7 Zone: R75
Application for: An area variance to permit a side yard setback of 10.9 feet where a minimum of 12 feet is required, a deficiency of 1.1 feet or 9 percent, to allow the construction of a rear addition to an existing single-family residence. The existing residence has an existing legally non-conforming side yard setback of 10.9 feet, so the proposed addition will increase the degree of dimensional non-conformity.
