  1. 05-75 25 Prospect Avenue

Section 75, Block 1, Lot 11A Zone: R5

Application for: An area variance to permit a side yard setback of 2 feet where a minimum of 8 feet is required, a deficiency of 6 feet or 75 percent. At a meeting on June 22, 2005, the applicant received site plan and architectural review approval for additions and alterations to an existing single-family residence that was legally non-conforming with regard to the side yard setback. The applicant was permitted to maintain the non-conforming setback since the drawings indicated that a minimum of 50 percent of the volume of the existing structure above the foundation would be maintained, in accordance with Section 6.E.2 of the Zoning Law. However, structural problems were discovered during construction making preservation of the existing walls difficult. Public hearing.

Section 66K, Block 1, Lot 141 Zone: R5

Application for: An area variance to permit the reconstruction of an existing driveway that is setback 0-feet from the property line where a minimum of 3 feet is required, a deficiency of 3 feet or 100 percent. Public hearing.

 

  1. 05-70 1 Shady Lane

Section 63G, Block 1, Lot 22 Zone: R6

Application for: Area variances from: (1) the minimum required front yard setback to permit the construction of a second-story addition with a front yard setback of 22.13 feet where a minimum of 30 feet is required, a deficiency of 7.87 feet or approximately 26 percent (the existing residence has a legal non-conforming setback of 20.63 feet; the proposed addition will increase the degree of dimensional non-conformity), and (2) to permit the construction of a roof over an existing front entry porch with a setback of 15.88 feet where a minimum setback of 26 feet is required, a deficiency of 9.12 feet or 36.5 percent (the existing uncovered front porch is legally non-conforming; the proposed roof will increase the degree of non-conformity). Public hearing.

Section 66G, Block 1, Lot 59 Zone: R5

Application for: Area variances to legalize an existing enclosed rear porch: (1) to permit a rear yard setback of 24 feet where a minimum of 25 feet is required, a deficiency of 1 foot or 4 percent, and (2) to permit a minimum 2.7 foot separation between the porch and the detached garage where a minimum separation of 10 feet is required, a deficiency of 7.3 feet or 73 percent. Public hearing.

ADJOURNED AT THE APPLICANT'S REQUEST

Section 44, Block 10, Lot 1 Zone: M350

Application for: An area variance to allow the placement of unmanned electronic equipment cabinets with a 10-foot side yard setback where a minimum 20-foot setback is required . The application is currently pending before the ZBA, ARB and Planning Board for special permit, site plan and architectural review approval for a proposed wireless communications facility consisting of rooftop mounted panel antennas and equipment cabinets situated at grade adjacent to the existing building. Application received preliminary special permit review at the April 12, 2005 ZBA meeting and architectural review at the June 22, 2005 ARB meeting. Subsequent to those meetings it was determined that the area variance was required and the application was returned to the ZBA. Public hearing.
