OLD BUSINESS

1. 05-86 Lou's Luncheonette, 33 Mill Road Public Hearing

Section 65D, Block 4, Lot 19 Zone: RB

Application for: A special permit and area variance from the minimum parking and loading requirements to permit a restaurant to occupy a storefront in an existing shopping center.

 

2. 05-95 46 Parkway Circle Public Hearing

Section 63D, Block 1, Lot 21 Zone: R6

Application for: An area variance from the minimum required frontage to permit a building lot with 50 feet of frontage where a minimum of 60 feet is required, a deficiency of 10 feet or 17 percent.

 

3. 05-22 New Cingular Wireless, PCS, LLC Public Hearing

Section 44, Block 10, Lot 1 Zone: M350

Application for: Final special permit approval for the installation of a wireless communications facility consisting of 12 panel antennas and related equipment cabinets mounted on the roof of an existing multi-family residential building. On May 22, 2005, the ZBA conducted a preliminary review of the application and referred it to the Planning Board for site plan and architectural review. On October 26, 2005, the Planning Board granted site plan and architectural review approval and referred the application back to the ZBA for the final special permit.

 

NEW BUSINESS

4. 05-97 137 Hillside Avenue Public Hearing

Section 44, Block 7, Lot 10 Zone: RB

Application for: An area variance to legalize an existing shed which is setback 1.5 feet from a side lot line where a minimum setback of 5 feet is required, a deficiency of 3.5 feet or 70 percent. A building permit for the shed was erroneously granted in December 2003.

 

5. 05-98 104 Clarence Road Public Hearing

Section 56, Block 1, Lot 8 Zone R5

Application for: Area variances: (1) to permit a front entry portico with a front yard setback of 23.5 feet where a minimum of 26 feet is required, a deficiency of 2.5 feet or 9.6 percent; and (2) to permit a second-story addition over an existing garage with a front yard setback of 24.3 feet where a minimum of 30 feet is required, a deficiency of 5.7 feet or 19 percent. The existing garage has a legal non-conforming setback of 24.3 feet, so the proposed second-story addition will increase the degree of dimensional non-conformity.

 

6. 05-101 25 Soundview Drive Public Hearing

Section 66C, Block 4, Lot 2 Zone R10

Application for: An area variance to legalize an existing basketball court that is located in both a front and side yard of a property where basketball courts are permitted to be located only within a rear yard and to permit the court to have a side yard setback of 12.6 feet where a minimum setback of 20 feet is required, a deficiency of 7.4 feet or 37 percent. In addition, a variance is required to legalize an existing pool that is setback 5.5 feet from a residence where a minimum setback of 14 feet is required a deficiency of 8.5 feet or 60.7 percent.

 

7. 05-105 2 Knollwood Road Public Hearing

Section 65E, Block 4, Lot 24 Zone R7.5

Application for: An area variance to permit a the construction of a one-story addition to a single-family residence with a side yard setback adjacent to a street of 11 feet where a minimum of 14 feet is required, a deficiency of 3 feet or 21.4 percent.

 

8. 05-107 113 White Road Public Hearing

Section 56, Block 4, Lots 1 and 2 Zone: R5

Application for: Area variances to allow the continuation of construction of a new single-family residence to permit: (1) a side yard setback of 7 feet where a minimum of 8 feet is required, a deficiency of 1 foot or 12.5 percent; and (2) a stairwell that is setback 5 feet from the property line where a minimum setback of 6 feet is required, a deficiency of 1 foot or 16.7 percent. The approved plans for the residence did not require a variance. However, the foundation survey prepared during the construction process revealed that the right foundation wall and stairwell did not meet the required setbacks as noted above.

Application for: A use variance to permit a car detailing business in an RB District.

 

2. 05-49 Walgreens, 370 White Plains Road Public Hearing

Section 66L, Block 1, Lots 2 and 4 Zone: ORB

Application for: An area variance from the minimum parking requirements for a proposed 10,500 square-foot Walgreens store with 55 on-site parking spaces where a minimum 70 spaces are required, a deficiency of 15 spaces or 21 percent.
