1. 05-43 Omnipoint Communications, Inc., 60 Glen Road Public Hearing
Section 40, Block 2, Lot 45 Zone: RB and R3
Application for: Final special permit approval for the installation of a wireless communications facility, consisting of 6 panel antennas and related equipment on the roof of an existing multi-family residential building. At a meeting on June 14, 2005, the ZBA conducted a preliminary review of the special permit use and referred the application to the Planning Board. At a meeting on January 25, 2006, the Planning Board granted final site plan and architectural review approval.
2. 06-01 876 and 878 White Plains Road Public Hearing
Section 53, Block 2, Lots 42 and 42A Zone: R5
Application for: Area variances related to a proposed 2-lot resubdivision to permit lots 42 and 42A to have frontages of 48.72 feet where a minimum of 50 feet is required, a deficiency of 1.28 feet or 2.6 percent. Currently, both lots front on White Plains Road and, with a minor lot-line adjustment (resubdivision), both lots would be fully conforming building lots. The applicant proposes to resubdivide the lots to front on Homestead Avenue. On January 25, 2006, the Planning Board conducted a preliminary review of the application and referred it to the ZBA with a recommendation in favor of the lots fronting on Homestead Avenue.
3. 06-08 458 California Road Public Hearing
Section 80H, Block 1, Lot 14 Zone: R7.5
Application for: An area variance to permit the construction of a one-story rear addition with a rear yard setback of 23 feet where a minimum of 25 feet is required, a deficiency of 2 feet or 8 percent.
4. 06-10 74 Dunwoodie Street Public Hearing
Section 59, Block 1, Lot 2 Zone: R5
Application for: An area variance to legalize and existing driveway gate measuring 7.9 feet high with a center ornament measuring 8 feet at its highest point and pillars measuring 6 feet high, whereas a maximum height of 4 feet is permitted.
5. 06-11 22 Claudet Way Public Hearing
Section 66D, Block 1, Lot 45 Zone: R10
Application for: Area variances to permit the construction of a shed that: (1) is setback 0.5 feet from the rear property line where a minimum setback of 8 feet is required, a deficiency of 7.5 feet or 96 percent; and (2) is 10' x 16' or 160 square feet where a maximum of 10' x 12' or 120 square feet is permitted, an excess of 33 percent.

Application for: An interpretation of the Zoning Law. Classic Audi, a legal non-conforming commercial use in a one-family residence district, proposes to expand a parking/vehicle display area. In accordance with Section 6.D. (and most specifically Section 6.D.3.) the Building Department has determined that a use variance is required to permit the proposed expansion. The applicant disagrees with this determination and seeks an interpretation from the ZBA.

Application for: Area variances to legalize an existing basketball as follows: to permit the court to be located in both a front and side yard of a property where basketball courts are permitted to be located only within a rear yard; (2) to permit the court to have a side yard setback of 12.6 feet where a minimum setback of 20 feet is required, a deficiency of 7.4 feet or 37 percent (setback must be verified by a surveyor); (3) permit a fence surrounding the basketball court that is higher than the maximum permitted 4-feet; and (4) from the minimum landscaping requirements for sports courts.
