OLD BUSINESS

1. 05-95 46 Parkway Circle

Section63D, Block1, Lot 21 Zone: R6

Application for: An area variance to permit a building lot with 50 feet of frontage where a minimum of 60 feet is required, a deficiency of 10 feet or 16.7 percent. Public hearing closed at the March 14, 2006 meeting.

 

2. 05-88 292 White Plains Road Public Hearing

Section75, Block 1, Lot 1 Zone: RB

Application for: A use variance to permit a car detailing business in an RB District and area variances from the special permit requirements for a car wash.

 

3. 05-101a 25 Soundview Drive

Section 66C, Block 4, Lot 2 Zone: R10

Application for: Area variances to legalize an existing basketball/tennis court as follows: (1) to permit the court to be located in a side yard of a property where courts are permitted to be located only within a rear yard; (2) to permit the court to have a side yard setback of 18 feet where a minimum setback of 20 feet is required, a deficiency of 2 feet or 10 percent. Public hearing closed at the March 14, 2006 meeting.

 

4. 06-20 Family and Community Services, 551 White Plains Road Public Hearing

ADJOURNED TO THE MAY 9, 2006 ZBA MEETING TO ALLOW FOR THE REVIEW OF NEWLY SUBMITTED MATERIALS.

Section 65, Block 1, Lot 21 Zone: R6

Application for: A use variance to allow a business or professional office use within a One-Family Residence District. In 1958, Family and Community Services, Inc. (FCS) received special permit approval to use the premises for its not-for-profit offices. FCS is relocating its facility and has listed the premises for sale.

 

NEW BUSINESS

5. 06-31 675 White Plains Road Public Hearing

Section 63E, Block 1, Lots 16 and 17 Zone: R5

Application for: An area variance from the minimum required lot area to permit a 4,500 square foot building lot where a minimum of 5,000 square feet is required, a deficiency of 500 square feet or 10 percent.

 

6. 06-27 9 Laurel Place Public Hearing

Section 65K, Block 6, Lot 115 Zone: R6

Application for: Area variances to legalize existing exterior basement stairs with Bilco doors that extend 5.75 feet into the side yard and 4.25 feet from the side property line, where a stairway may extend only 4 feet into any side yard and must be 6 feet from any side property line. This is a deficiency of 1.75 feet or 29 percent. On June 29, 2005, a building permit was issued to construct the stairs which were constructed according to the approved plans. However, during an inspection of the poured concrete steps, it was discovered that a variance was required.

 

7. 06-13 138 Woodruff Avenue Public Hearing

Section 59, Block 4, Lot 15 Zone: RTD

Application for: Area variances for lot area, rear yard setback, first side yard setback, second side yard setback, building coverage, impervious surface coverage, and parking. These area variances are needed to convert an existing legal dimensionally non-conforming office building for use as a two-family residence. Currently the lot is 2,500 square feet where a minimum of 6,000 square feet is required for two-family residences, a deficiency of 3,500 square feet. The existing building has rear yard, first side yard, and second side yard setbacks of 10 feet, 2.8 feet, and .21 feet respectively, where setbacks of 25 feet, 8 feet and 9 feet are required. Existing building coverage and impervious surface coverage is 53 percent and 95 percent, respectively, where a maximum of 28 percent and 65 percent is permitted. Two parking spaces are provided where a minimum of 4 spaces are required.

 

8. 06-22 31 Stewart Place Public Hearing

Section 65A, Block 3, Lot 9 Zone: R7.5

Application for: An area variance from the minimum lot area to permit a new 5,601 square foot building lot where a minimum of 7,500 square feet is required, a deficiency of 1,899 square feet or 25.3 percent.

 

9. 06-30 47 Woodruff Avenue Public Hearing

Section 57, Block 4, Lot 29 Zone: R5

Application for: Area variance to allow the addition of a mudroom with a side yard setback of 4.97 feet, where a minimum setback of 8 feet is required, a deficiency of 3.03 feet, or 37.9 percent.

 

10. 06-21 31 Hewitt Avenue Public Hearing

Section 84, Block 1, Lot 4 Zone: R20

Application for: An area variance to permit pool equipment to remain 0.9 feet from the rear property line, where a minimum setback of 15 feet is required, a deficiency of 99.4 percent. At a meeting on October 11, 2005, the ZBA granted an area variance to permit an existing oversize shed/cabana to remain, subject to the condition that “the pool equipment and machinery currently located on the rear property line be removed from its current location and relocated inside the shed”.

 

11. 06-26 61 Bradley Road Public Hearing

Section 62, Block 2, Lot 35 Zone: R5

Application for: An area variance to permit a driveway that is located 14 inches from the side property line where a minimum setback of 3 feet is required, a deficiency of 22 inches or 61 percent.
