OLD BUSINESS

1. 06-20 Family and Community Services, 551 White Plains Road Public Hearing

Section 65, Block 1, Lot 21 Zone: R6

Application for: A use variance to allow a business or professional office use within a One-Family Residence District. In 1958, Family and Community Services, Inc. (FCS) received special permit approval to use the premises for its not-for-profit offices. FCS is relocating its facility and has listed the premises for sale.

 

2. 06-13 138 Woodruff Avenue Public Hearing

Section 59, Block 4, Lot 15 Zone: RTD

Application for: Area variances for lot area, rear yard setback, first side yard setback, second side yard setback, building coverage, impervious surface coverage, and parking. These area variances are needed to convert an existing legal dimensionally non-conforming office building for use as a two-family residence. Currently the lot is 2,500 square feet where a minimum of 6,000 square feet is required for two-family residences, a deficiency of 3,500 square feet. The existing building has rear yard, first side yard, and second side yard setbacks of 10 feet, 2.8 feet, and .21 feet respectively, where setbacks of 25 feet, 8 feet and 9 feet are required. Existing building coverage and impervious surface coverage is 53 percent and 95 percent, respectively, where a maximum of 28 percent and 65 percent is permitted. Two parking spaces are provided where a minimum of 4 spaces are required.

 

3. 06-22 31 Stewart Place Public Hearing

Section 65A, Block 3, Lot 9 Zone: R7.5

Application for: Area variances related to a proposed two-lot subdivision which will result in a new 5,601 square foot vacant building lot and a 7,500 square foot lot improved with an existing legal non-conforming 3-family residence. Specifically, the application requires a variance from the minimum lot area to permit the 5,601 square foot building lot where a minimum of 7,500 square feet is required, a deficiency of 1,899 square feet or 25.3 percent and an area variance to permit the existing 3-family residence to have a gross floor area of 3066 square feet where a maximum of 3000 square feet is permitted, an excess of 66 square feet or 2.2 percent.

 

NEW BUSINESS

4. 06-32 46 Morgan Street Public Hearing

Section 40, Block 6, Lot 7 Zone: R3

Application for: Area variances to permit a new two-family residence on a lot with an area of 5,382 square feet where a minimum of 6,000 square feet is required, a deficiency of 618 square feet, or 10.3 percent. The new residence is proposed to replace an existing dimensionally non-conforming (with regard to setbacks) two-family residence.

 

5. 06-34 11 Hillary Way Public Hearing

Section 65N, Block 5, Lot 104A Zone: R6

Application for: Area variances to permit the construction of an in-ground swimming pool with a rear yard setback of 5 feet where a minimum of 10 feet is required for each, a deficiency of 5 feet or 50 percent; and an area variance to permit a fence 5 feet high within the side and front yards where a maximum height of 4 feet is permitted, an excess of 1 foot or 25 percent.

 

6. 06-35 32 Nelson Road Public Hearing

Section 62, Block 1, Lot 16 Zone: R5

Application for: An area variance to permit an open porch with a width of 46.5 feet where a maximum width equivalent to 30 percent of the building frontage or 11.4 feet is required, an excess of 35.1 feet or 308 percent.

 

7. 06-37 106 Gaylor Road Public Hearing

Section 54, Block 6, Lot 29 Zone: R5

Application for: Area variances to permit the continued construction of a garage with a side yard setback of 1.7 feet, a rear yard setback of 1.75 feet, and a distance to principal building of 3.9 feet, where minimum side and rear yard setbacks are both 5 feet and a minimum required distance to the principal building is 10 feet. The side yard setback is a deficiency of 3.3 feet or 66 percent; the rear yard setback is a deficiency of 3.25 feet or 65 percent; and the distance to the principal building is a deficiency of 6.1 feet or 61 percent.

 

8. 06-39 19 Longview Drive Public Hearing

Section 66E, Block 2, Lot 31 Zone: R6

Application for: An area variance to permit a 6-foot high fence along a side lot line where a maximum height of 4 feet is permitted, an excess of 2 feet, or 50 percent.

 

9. 06-46 737 White Plains Road Public Hearing

Section 63A, Block 2, Lot 23B Zone: RB

Application for: Area variances to permit the construction of a 2,840 square-foot commercial building with one side yard setback of 0 feet where a minimum of 10 feet is required, a deficiency of 10 feet or 100 percent, and ; 18 parking spaces where 19 spaces are required, a deficiency of 1 space or 5 percent. In addition, an area variance from the minimum landscaping requirements for parking lots is required.

 

10. 06-47 21 Brambach Avenue Public Hearing

Section 50, Block 2, Lot 14 Zone: R5

Application for: An area variance to permit a second floor addition to the front of a dimensionally non-conforming single-family residence with an existing front yard setback of 15.4 feet a where a minimum of 30 feet is required, a deficiency of 14.6 feet or 49 percent.

 

11. 06-48 155 Locust Avenue Public Hearing

Section 56, Block 2, Lot 33 Zone: R5

Application for: An area variance from the gross floor area requirement to permit a 1,092 square foot two-story addition to the rear of a single-family residence. The proposed total gross floor area is 2,477.65 square feet where a GFA of 2,300 square feet is permitted, an excess of 177.65 feet or 8 percent.

 

12. 06-49 109 Park Drive Public Hearing

Section 65C, Block 6, Lot 26 Zone: R7.5

Application for: An area variance from the side yard setback to permit a one-story side addition to a single-family residence. The addition will result in a side yard setback of 7.5 feet where a minimum of 12 feet is required, a deficiency of 4.5 feet or 37.5 percent.

 

13. 06-50 443 White Plains Road Public Hearing

Section 44, Block 3, Lot 3 Zone: RB

Application for: A special permit for a proposed carry-out restaurant and area variance from the off-street parking requirements. The carry-out restaurant is proposed to occupy space formerly used for retail and personal service uses.
