OLD BUSINESS

1. 06-20 Family and Community Services, 551 White Plains Road

Section 65, Block 1, Lot 21 Zone: R6

Application for: A use variance to allow a professional office use within a One-Family Residence District. In 1958, Family and Community Services, Inc. (FCS) received special permit approval to use the premises for its not-for-profit offices. FCS is relocating its facility and has listed the premises for sale.

2. 06-34 11 Hillary Way Public Hearing

Section 65N, Block 5, Lot 104A Zone: R6

Application for: Area variances to permit the construction of an in-ground swimming pool with a rear-yard setback of 5 feet where a minimum of 10 feet is required, a deficiency of 5 feet or 50 percent, and a setback from the principal building of 6 feet where a minimum of 10 feet is required a deficiency of 4 feet or 40 percent.

3. 06-37 106 Gaylor Road Public Hearing

Section 54, Block 6, Lot 29 Zone: R5

Application for: Area variances to permit the continued construction of a garage with a side- yard setback of 1.7 feet, a rear-yard setback of 1.75 feet, and a distance to principal building of 5.5 feet, where minimum side- and rear-yard setbacks are both 5 feet and a minimum required distance to the principal building is 10 feet. The side-yard setback is a deficiency of 3.3 feet or 66 percent; the rear-yard setback is a deficiency of 3.25 feet or 65 percent; and the distance to the principal building is a deficiency of 4.5 feet or 45 percent.

Section 44, Block 3, Lot 3 Zone: RB

Application for: A special permit for a proposed carry-out restaurant. The carry-out restaurant is proposed to occupy space formerly used for retail and personal service uses.

5. 05-84 Classic Audi, 541 White Plains Road Public Hearing

Section 48, Block 1, Lot 26 Zone: R6

Application for: An interpretation of the Zoning Law to determine whether a proposed expansion to a car dealership requires a use variance.


6. 06-54 193 Old Wilmot Road Public Hearing

Section 64D, Block 4, Lot 20 Zone: R7.5

Application for: Area variances to permit a second story addition with a first side-yard setback of 11.67 feet and a second side-yard setback of 11.85 feet where a minimum of 12 feet is required for both, a deficiency of 0.33 feet and 0.15 feet, or 2.75 percent and 1.25 percent, respectively. The existing structure is legally non-conforming with regard to these setbacks. As a result, the proposed addition will increase the degree of dimensional non-conformity.

7. 06-55 17 Columbus Circle Public Hearing

Section 66C, Block 2, Lot 29 Zone: R10

Application for: An area variance to permit a two-story addition to an existing single-family residence with one side-yard setback of 5.8 feet where a minimum of 14 feet is required, a deficiency of 8.2 feet or 58.6 percent.

8. 06-57 100 Stewart Avenue, St. Luke's Church Public Hearing

Section 48, Block 2, Lot 15 Zone: R6

Application for: A special permit to allow a non-profit community service facility to occupy space within an existing church.

9. 06-63 87 Waverly Avenue Public Hearing

Section 70, Block 4, Lot 26 Zone: R5

Application for: An area variance from the maximum permitted gross floor area to permit a one-story rear addition resulting in a total gross floor area of 2,612 square feet where a maximum of 2,410.46 square feet is permitted, an excess of 201.54 square feet or 8 percent.

10. 06-65 8 Scarsdale Avenue Public Hearing

Section 63C, Block 1, Lot 17 Zone: R6

Application for: An area variance to enclose an existing screen porch with a side-yard setback of 9.37 feet where 10 feet is required, a deficiency of 0.63 feet, or 6.3 percent.

11. 06-66 478 California Road Public Hearing

Section 80H, Block 1, Lot 6A Zone: R7.5

Application for: Area variances to permit a two-story addition to an existing single-family residence with: a gross floor area of 3,809 square feet where a maximum of 3,362 square feet is permitted, an excess of 447 square feet or 13.3 percent; a front-yard setback of 10 feet where a minimum of 30 feet is required, a deficiency of 20 feet or 66.7 percent; a side-yard setback of 11.5 feet where a minimum of 12 feet is required, a deficiency of 0.5 feet or 4 percent; and an open porch with a front yard setback of 15 feet where a minimum of 26 feet is required, a deficiency of 11 feet or 42.3 percent.

Section 59, Block 4, Lot 15 Zone: RTD

Application for: Area variances from the required lot area, rear-yard setback, first side-yard setback, second side-yard setback, building coverage, impervious surface coverage, and parking. These area variances are needed to convert an existing legal dimensionally non-conforming office building for use as a two-family residence. Currently the lot is 2,500 square feet where a minimum of 6,000 square feet is required for two-family residences, a deficiency of 3,500 square feet. The existing building has rear-yard, first side-yard, and second side-yard setbacks of 10 feet, 2.8 feet, and .21 feet respectively, where setbacks of 25 feet, 8 feet and 9 feet are required. Existing building coverage and impervious surface coverage is 53 percent and 95 percent, respectively, where a maximum of 28 percent and 65 percent is permitted. Two parking spaces are provided where a minimum of 4 spaces are required.

Application for: Area variances related to a proposed two-lot subdivision which will result in a new 5,601 square-foot building lot and a 7,500 square-foot lot improved with an existing legal non-conforming 3-family residence. Specifically, the application requires a variance from the minimum lot area to permit the 5,601 square-foot building lot where a minimum of 7,500 square feet is required, a deficiency of 1,899 square feet or 25.3 percent; an area variance to permit the existing 3-family residence to have a gross floor area of 3,066 square feet where a maximum of 3,000 square feet is permitted, an excess of 66 square feet or 2.2 percent; and an area variance from the minimum off-street parking requirements for the existing 3- family residence.

Application for: Area variances to permit the construction of a 2,840 square-foot commercial building with one side yard setback of 0 feet where a minimum of 10 feet is required, a deficiency of 10 feet or 100 percent, and; 18 parking spaces where 19 spaces are required, a deficiency of 1 space or 5 percent. In addition, an area variance from the minimum landscaping requirements for parking lots is required.

Application for: Area variances to legalize two separate additions to a single-family residence with a rear-yard setback of 21 feet where a minimum of 25 feet is required, a deficiency of 4 feet or 16 percent; and a gross floor area of 4,103.48 square feet where a maximum of 3,325.10 square feet is permitted, an excess of 778.38 square feet or 23.4 percent.
