OLD BUSINESS

1. 06-20 Family and Community Services, 551 White Plains Road

Section 65, Block 1, Lot 21 Zone: R6

Application for: A use variance to allow a professional office use within a One-Family Residence District. In 1958, Family and Community Services, Inc. (FCS) received special permit approval to use the premises for its not-for-profit offices. FCS is relocating its facility and has listed the premises for sale. Public hearing closed May 9, 2006.

 

2. 05-84 Classic Audi, 541 White Plains Road Public Hearing

Section 48, Block 1, Lot 26 Zone: R6

Application for: An interpretation of the Zoning Law to determine whether a proposed expansion to a car dealership requires a use variance.

 

3. 06-22 31 Stewart Place Public Hearing

Section 65A, Block 3, Lot 9 Zone: R7.5

Application for: Area variances related to a proposed two-lot subdivision which will result in a new 5,601 square-foot building lot and a 7,500 square-foot lot improved with an existing legal non-conforming 3-family residence. Specifically, the application requires a variance from the minimum lot area to permit the 5,601 square-foot building lot where a minimum of 7,500 square feet is required, a deficiency of 1,899 square feet or 25.3 percent; an area variance to permit the existing 3-family residence to have a gross floor area of 3,066 square feet where a maximum of 3,000 square feet is permitted, an excess of 66 square feet or 2.2 percent; and an area variance from the minimum off-street parking requirements for the existing 3- family residence.

 

4. 06-46 737 White Plains Road

Section 63A, Block 2, Lot 23B Zone: RB

Application for: Area variances to permit the construction of a 2,840 square-foot commercial building with one side yard setback of 0 feet where a minimum of 10 feet is required, a deficiency of 10 feet or 100 percent, and; 18 parking spaces where 19 spaces are required, a deficiency of 1 space or 5 percent. In addition, an area variance from the minimum landscaping requirements for parking lots is required. The public hearing closed May 9, 2006.

NEW BUSINESS

5. 06-64 196 Oakland Avenue Public Hearing

Section 65E, Block 1, Lot 12 Zone: R7.5

Application for: Area variances to legalize two separate additions to a single-family residence with a rear-yard setback of 21 feet where a minimum of 25 feet is required, a deficiency of 4 feet or 16 percent; and a gross floor area of 4,103.48 square feet where a maximum of 3,325.10 square feet is permitted, an excess of 778.38 square feet or 23.4 percent.

 

6. 06-71 203 Park Drive Public Hearing

Section 63E, Block 5, Lot 23 Zone: R5

Application for: Area variances to permit a second story addition resulting in a total gross floor area of 2,352.75 square feet where a maximum gross floor area of 2,300 square feet is permitted, an excess of 52.75 feet or 2.3 percent; and a ridge height of 37 feet where a maximum of 33 feet is permitted, an excess of 4 feet or 12.1 percent.

Application for: Area variances to permit a two-story addition to an existing single-family residence with: a gross floor area of 3,809 square feet where a maximum of 3,362 square feet is permitted, an excess of 447 square feet or 13.3 percent; a front-yard setback of 10 feet where a minimum of 30 feet is required, a deficiency of 20 feet or 66.7 percent; a side-yard setback of 11.5 feet where a minimum of 12 feet is required, a deficiency of 0.5 feet or 4 percent; and an open porch with a front yard setback of 15 feet where a minimum of 26 feet is required, a deficiency of 11 feet or 42.3 percent.

Application for: Area variances to permit the construction of a second story addition and new garage resulting in a rear yard setback of 18.52 feet where a minimum of 25 feet is required, a deficiency of 6.48 feet or 25.9 percent; and a gross floor area of 3,335 square feet where a maximum of 3,127 square feet is permitted, an excess of 208 square feet or 6.7 percent.
