OLD BUSINESS

1. 05-84 Classic Audi, 541 White Plains Road Public Hearing

Section 48, Block 1, Lot 26 Zone: R6

Application for: an interpretation of the Zoning Law to determine whether a proposed expansion to an existing car dealership requires a use variance.

 

2. 06-22 31 Stewart Place

Section 65A, Block 3, Lot 9 Zone: R7.5

Application for: Area variances related to a proposed two-lot subdivision which will result in a new 5,601 square-foot building lot and a 7,500 square-foot lot improved with an existing legal non-conforming 3-family residence. Specifically, the application requires an area variance from the minimum lot area to permit the 5,601 square-foot building lot where a minimum of 7,500 square feet is required, a deficiency of 1,899 square feet or 25.3 percent; an area variance to permit the existing 3-family residence to have a gross floor area of 3,066 square feet where a maximum of 3,000 square feet is permitted, an excess of 66 square feet or 2.2 percent; an area variance from the effective square requirement; and an area variance from the minimum off-street parking requirements for the existing 3-family residence. Public hearing closed on May 9, 2006.

 

3. 06-83 9 Green Meadow Road Public Hearing

Section 66H, Block 1, Lot 56 Zone: R5

Application for: an area variance to permit an addition to the front of a single-family residence with a front yard setback of 24.5 feet where a minimum setback of 30 feet is required, a deficiency of 5.5 feet or 18.3 percent.

 

4. 06-89 63 Anderson Avenue Public Hearing

Section 51, Block 3, Lots 25 and 27 Zone: R5

Application for: area variances to permit a two story addition to the side and rear of an existing single-family residence with a front porch setback of 15.8 feet where a minimum of 26 feet is required, a deficiency of 10.2 feet or 39.2 percent; a front yard setback for the addition of 21.83 feet where a minimum of 30 feet is required, a deficiency of 8.17 feet or 27.2 percent; and a gross floor area of 2,760.3 square feet where a maximum of 2,550 square feet is permitted, an excess of 210.3 square feet or 8.2 percent.

 

NEW BUSINESS

5. 06-100 Mickey Spillane's, 431 White Plains Road Public Hearing

Section 44, Block 3, Lot 7 Zone: RB

Application for: amended special permit approval and an area variance from the minimum parking requirements to permit the expansion of Mickey Spillane's to include a private party room and office and storage facilities on the second floor of the building above the existing restaurant. A minimum of 15 off-street parking spaces are required for the expansion and 0 spaces are proposed, a deficiency of 100 percent.

 

6. 06-91 Commerce Bank, 685 White Plains Road Public Hearing

Section 63, Block 1, Lots 1-8 Zone: R5

Application for: a use variance to permit the construction of a new 5,014 square-foot bank with 25 off-street parking spaces within the R5, One Family Residence District.

 

7. 06-90 92 Brook Street Public Hearing

Section 58, Block 5, Lot 14 Zone: RB

Application for: area variances from the minimum off-street parking requirements and the minimum aisle width to permit additions and alterations to an existing structure. A hair salon is proposed for the basement level and two apartments are proposed for the first and second floors. A minimum of 10 off-street parking spaces are required (6 for the hair salon and 4 for the apartments) and 6 spaces are proposed, a deficiency of 4 spaces or 40 percent. An aisle width of 21.5 feet is proposed where a minimum aisle width of 25 feet is required, a deficiency of 3.5 feet or 14 percent.

 

8. 06-102 15 Cypress Road Public Hearing

Section 66L, Block 4, Lot 232 Zone: R5

Application for: area variance to legalize a one-story addition with a rear yard setback of 21.2 feet where a minimum setback of 25 feet is required, a deficiency of 3.8 feet or 15.2 percent.

 

9. 06-99 2 Archer Drive Public Hearing

Section 80B, Block 4, Lot 34 Zone: R3

Application for: an area variance to permit the expansion of a side entrance with a side yard setback of 8.5 feet where a minimum setback, for a stairway in a side yard facing the street, of 10 feet is required, a deficiency of 1.5 feet or 15 percent.

 

10. 06-101 27 Winding Lane Public Hearing

Section 63G, Block 3, Lot 73 Zone: R6

Application for: an area variance to legalize a one-story addition and attached garage for a single-family residence resulting in a rear yard setback of 7.4 feet where a minimum setback of 25 feet is required, a deficiency of 17.6 feet or 70.4 percent.

 

11. 06-103 Three Olives Restaurant Group, 219 Main Street Public Hearing

Section 68, Block 1, Lots 11 Zone: RB

Application for: a special permit to operate a restaurant, and an area variance from the off-street parking requirement. A minimum of 50 off-street parking spaces are required and 0 spaces are proposed, a deficiency of 50 spaces or 100 percent.

Application for: Area variances to legalize two separate additions to a single-family residence with a rear-yard setback of 21 feet where a minimum of 25 feet is required, a deficiency of 4 feet or 16 percent; and a gross floor area of 4,103.48 square feet where a maximum of 3,325.10 square feet is permitted, an excess of 778.38 square feet or 23.4 percent.
