1. 08-14 490-498 New Rochelle Road Public Hearing
Section 85, Block 3, Lot 13 Zone: RB
Application for: an area variance from the minimum off-street parking requirement for a retail and multi-family residential building to permit the conversion of one apartment for use as a personal service establishment, requiring 4 additional off-street parking spaces for a total of 29 required off-street parking spaces for the building, where 0 parking spaces are provided, a deficiency of 29 spaces or 100 percent. Although the proposed use only requires a net increase of 4 additional parking spaces, Section 13.B of the Zoning Law requires that parking for all existing uses be provided at the time of any enlargement of an existing structure or use. As a result, a variance is required to permit 0 spaces where 29 spaces are required.

Section 56, Block 1, Lot 13 Zone: R5
Application for: an area variance to legalize an existing covered rear deck with a rear yard setback of 17.1 feet where a minimum setback of 19 feet is required for a deck, a deficiency of 1.9 feet or 10 percent.
3. 08-19 1 Webster Road Public Hearing
Section 61, Block 4, Lots 27 and 29 Zone: R5
Application for: a re-designation of the front yard for a corner lot to designate the yard fronting on Webster Road to be the front yard to permit a pool in the proposed rear yard; or, if this requested is not granted, the applicant is requesting an area variance to permit a pool, to be located within a side yard where residential pools are only permitted in a rear yard, and with a setback from the principal building of 5 feet where a minimum of 10 feet is required, a deficiency of 5 feet or 50 percent.
4. 08-20 12 Alta Drive Public Hearing
Section 85, Block 2, Lot 24 Zone: R5
Application for: area variances to enclose a front porch and construct a one-story side addition to an existing single-family residence with: a front yard setback of 24.9 feet where a minimum setback of 30 feet is required, a deficiency of 5.1 feet or 17 percent; a side yard setback of 6.5 feet where a minimum setback of 8 feet is required, a deficiency of 1.5 feet or 18.8 percent; and a second side yard setback of 4.1 feet where a minimum setback of 9 feet is required, a deficiency of 4.9 feet or 54 percent.
5. 08-21 9 Bronson Avenue Public Hearing
Section 63C, Block 1, Lot 4 Zone: R6
Application for: area variances to permit a two story rear addition with: an eave height of 26 feet where a maximum height of 23 feet is permitted, an excess of 3 feet or 13 percent; a gross floor area (GFA) of 2,714 square feet where a maximum GFA of 2,645 square feet is permitted, an excess of 69 square feet or 2.6 percent; and a building height of 3 stories where a maximum building height of 2.5 stories is permitted.

Section 65A, Block 3, Lots 9.1 and 9.2 Zone: R7.5
Application for: area variances to permit a redivision and minor subdivision of two existing building lots to create one new building lot. Area variances are requested from the effective square requirement for the proposed new lot and from the maximum permitted gross floor area (GFA) for the existing residence which is 3,066 square feet where a maximum of 3,018 square feet is permitted, an excess of 48 square feet or 1.6 percent. (The ZBA must also determine if the matter shall be considered a rehearing of a previous application -- Application 06-22, denied by the ZBA on November 14, 2006 -- or whether based on the new facts and circumstances presented, it may be considered a new application).
