OLD BUSINESS

1. 07-58 31 Stewart Place Public Hearing - Continuation

Section 65A, Block 3, Lots 9.1 and 9.2 Zone: R7.5

Application for: area variances to permit a redivision and minor subdivision of two existing building lots to create one new building lot. Area variances are requested from the effective square requirement for the proposed new lot and from the maximum permitted gross floor area (GFA) for the existing residence which is 3,066 square feet where a maximum of 3,018 square feet is permitted, an excess of 48 square feet or 1.6 percent. (The ZBA must also determine if the matter shall be considered a rehearing of a previous application -- Application 06-22, denied by the ZBA on November 14, 2006 -- or whether based on the new facts and circumstances presented, it may be considered a new application).

2. 08-19 1 Webster Road Public Hearing - Continuation

Section 61, Block 4, Lots 27 and 29 Zone: R5

Application for: an area variance to permit a pool with a setback from the principal building of 5 feet where a minimum of 10 feet is required, a deficiency of 5 feet or 50 percent.

3. 08-26 166 Montgomery Avenue Public Hearing

Section 60, Block 3, Lot 5 Zone: R5

Application for: an area variance to legalize an existing 6 foot high fence in the left side and right side yards and within the front yard along the right side property line, where the maximum permitted height for a fence is 4 feet, an excess of 2 feet or 50 percent.

4. 08-27 1 Hickory Hill Road Public Hearing

Section 66E, Block 1, Lot 1 Zone: R6

Application for: an area variance to permit a 6 foot high fence in the left side yard, where the maximum permitted height for a fence in a side yard is 4 feet, an excess of 2 feet or 50 percent.

5. 08-28 62 Ridge Street Public Hearing

Section 77, Block 3, Lot 27 Zone: R5

Application for: an area variance to permit a deck with side yard setback of 5 feet where a minimum setback of 6 feet is required for a deck, a deficiency of 1 foot or 16.7 percent.

 

6. 08-30 12 Waterside Close Public Hearing

Section 64P, Block 1, Lot 13 Zone: 1.5C

Application for: area variances to permit the enclosure of an existing deck with a rear yard setback of 6 feet where a minimum setback of 10 feet is required, a deficiency of 4 feet or 40 percent; and a gross floor area of 2,244 square feet where maximum gross floor area of 1,646 is permitted, an excess of 36.3 percent. (The existing residence has a legal non-conforming gross floor area of 2,100 square feet. The proposed gross floor area for the sunroom is 144 square feet.)

Application for: area variances related to a proposed two-lot subdivision including variances from the effective square requirement for both lots and area variances to permit frontages of 50 feet, for both lots, where a minimum of 60 feet is required, a deficiency of 10 feet or 16.7 percent.

Application for: an area variance to legalize an existing rear addition with a left side yard setback of 6.45 feet where a minimum setback of 8 feet is required, a deficiency of 1.55 feet or 19.4 percent. (The existing residence has a legal non-conforming left side yard setback of 6.45 feet.)

 

4. 08-29 26 Arlington Road Public Hearing

Application for: an area variance to legalize a one-story rear addition with a rear yard setback of 20.5 feet where a minimum setback of 25 feet is required, a deficiency of 4.5 feet or 18 percent; and to permit a second story addition above with a rear yard setback of 20.5 feet where a minimum setback of 25 feet is required, a deficiency of 4.5 feet or 18 percent.
