OLD BUSINESS

1. 07-58 31 Stewart Place Public Hearing - Continuation

Section 65A, Block 3, Lots 9.1 and 9.2 Zone: R7.5

Application for: area variances to permit a redivision and minor subdivision of two existing building lots to create one new building lot. Area variances are requested from the effective square requirement for the proposed new lot and from the maximum permitted gross floor area (GFA) for the existing residence which is 3,066 square feet where a maximum of 3,018 square feet is permitted, an excess of 48 square feet or 1.6 percent.

2. 07-92 85 Tuckahoe Avenue Public Hearing

Section 71, Block 1, Lot 21 Zone: R6

Application for: area variances related to a proposed two-lot subdivision including variances from the effective square requirement for both lots and area variances to permit frontages of 50 feet, for both lots, where a minimum of 60 feet is required, a deficiency of 10 feet or 16.7 percent.

3. 08-38 Prodigy Learning Center, 774 White Plains Road Public Hearing

Section 61, Block 3, Lot 16 Zone: RB

Application for: an area variance from the special permit requirement for a private learning center requiring separate bathroom facilities for males and females. If the variance is granted, the applicant will request special permit approval from the Planning Board to permit a private learning center in an existing commercial building in accordance with Section 12.H.16 of the Zoning Law.

4. 08-29 26 Arlington Road Public Hearing

Section 64A, Block 2, Lot 30 Zone: R7.5

Application for: an area variance to permit a two-story rear addition with a rear yard setback of 19 feet where a minimum setback of 25 feet is required, a deficiency of 6 feet or 24 percent. The granting of this area variance will legalize the existing one-story addition which has a rear yard setback of 20.05 feet.

5. 08-22 144 Gaylor Road Public Hearing

Section 54, Block 5, Lot 30 Zone: R5

Application for: an area variance to legalize an existing rear addition with a left side yard setback of 6.45 feet where a minimum setback of 8 feet is required, a deficiency of 1.55 feet or 19.4 percent. (The existing residence has a legal non-conforming left side yard setback of 6.45 feet.)

6. 08-32 6 Wildwood Road Public Hearing

Section 64J, Block 2, Lot 7 Zone: R15

Application for: an area variance to construct a side addition, including a two-car garage and breezeway, to an existing single-family residence with a side yard setback of 6.48 feet where a minimum of 14 feet is required, a deficiency of 7.52 feet or 53.7 percent.

7. 08-35 1 Corwood Road Public Hearing

Section 79D, Block 4, Lot 4 Zone: R20

Application for: an area variance to legalize an existing fence with a height of 6 feet along a side property line where a maximum height of 4 feet is permitted for a fence in a side yard, a deficiency of 2 feet or 50 percent.

8. 08-41 19 Hilltop Road Public Hearing

Section 7D, Block 2, Lots 2 and 3 Zone: R10

Application for: an area variance to permit a portion of a driveway and entry court to have a width of 40 where a maximum driveway width of 20 feet is permitted, an excess of 20 feet or 50 percent.

9. 08-42 141 Hillside Place Public Hearing

Section 44, Block 7, Lot 8 Zone: RB

Application for: an area variance from the minimum off-street parking requirement for an office and multi-family residential building to permit the conversion of one first floor apartment for use as an office, requiring 4 additional off-street parking spaces for a total of 11 required off-street parking spaces for the building, where 4 parking spaces are provided, a deficiency of 7 spaces or 63.6 percent. Although the proposed use only requires a net increase of 4 additional parking spaces, Section 13.B of the Zoning Law requires that parking for all existing uses be provided at the time of any enlargement of an existing structure or use. As a result, a variance is required to permit 4 spaces where 11 spaces are required.

10. 08-43 603 California Road Public Hearing

Section 79D, Block 3, Lot 12A Zone: R15

Application for: area variances to construct a sunroom over an existing patio with: a setback from the existing pool of 4.6 feet where a minimum setback of 16 feet is required, a deficiency of 11.4 feet or 71.3 percent; and a total gross floor area for the residence of 6,035 square feet where a maximum permitted gross floor area of 4,268.8 square feet is permitted, an excess of 1,766.2 square feet or 41.4 percent. (The existing residence has a legal non-conforming gross floor area of 6,035 square feet. The proposed sunroom is 285 square feet.)

11. 08-45 146 Summerfield Street Public Hearing

Section 59, Block 6, Lot 4 Zone: GB

Application for: area variances to permit the construction of an accessory structure to a two family residence, including a garage and storage space above, with: two-stories where an accessory structure is only permitted to be one-story high; and with a height of 21 feet where the maximum height for an accessory structure is 15 feet, an excess of 6 feet or 40 percent.
