Minutes of a regular meeting of the Town Board of the Town of Eastchester held on October 5, 2005, at 8:00 p.m., at the Town Hall, Eastchester, New York.

SPECIAL PRESENTATIONS - TRAFFIC EXPO
Dr. Elliot Senderoff invited the Town Board and the public to attend the Traffic Expo/Kids Day America to be held on Saturday, October 8th at Town Hall.
A) CONTINUTATION OF PUBLIC HEARING TO CONSIDER THE ADOPTION OF A PROPOSED LOCAL LAW PROVIDING FOR THE FILMING AND VIDEOTAPING WITHIN THE UNINCORPORATED TOWN OF EASTCHESTER
Supervisor Colavita offered a motion that was seconded by Councilwoman Ford to re-open the Public Hearing on Local Law 14-2005 (Filming and Videotaping).
On the roll call, all voted "AYE," except Councilman DelVecchio who was ABSENT. Motion carried.
Supervisor Colavita reviewed the minor changes made to the Proposed Local Law since being introduced; the minimum fee was reduced from $500 to $50 per day and an exemption was made for anyone filming a single event.
John Fix, 56 Orchard Street, spoke in support of the reduction of the minimum fee to $50 and thanked the Town Board for taking into consideration the issues discussed during the Public Hearing held September 20, 2005.
There being no further public comment, Supervisor Colavita offered a motion that was seconded by Councilwoman Ford to close the Public Hearing.
On the roll call, all voted "AYE," except Councilman DelVecchio who was ABSENT. Motion carried.
Councilwoman Ford offered a motion that was seconded by Councilman Cacciola to adopt Local Law 14-2005. The following is the text of Local Law 14-2005 as adopted:
LOCAL LAW 14 -2005 OF THE TOWN OF EASTCHESTER
A LOCAL LAW ON FILMING AND VIDEOTAPING WITHIN THE UNINCORPORATED TOWN OF EASTCHESTER
BE IT ENACTED by the town governing body of the Town of Eastchester as follows:
This local law shall be known and may be cited as the Filming and Videotaping Law of 2005 within the unincorporated Town of Eastchester.
It is the intent of the Town to facilitate, but not solicit, producers and others within the mass communications industries, including filming and television, to make use of the Town and its surroundings as a setting for motion-picture films, television shows and commercials but only insofar as such use is at all times compatible, and does not unduly interfere, with the lifestyles and day-to-day activities of the Town's citizens and merchants.
For the purpose of this Local Law, the following terms, phrases and words and their derivations shall have the following meanings given herein:
FILMING - The recording on film, videotape or other medium of movies, commercials, documentaries, serials, shows, performances, or other similar events or activities, including but not to include the coverage of news, political, cultural, local sports or school events. This does not apply when such filming is confined within the parameters of a structure and does not interfere with pedestrian or vehicle right of ways or creates a nuisance. Neither does it apply to video taping social events such as weddings or graduations. The right to apply for a license and the issuance thereof is subject to all local laws.
LICENSEE - Any person, firm, organization or business entity which has been licensed under the provision of this Local Law.
PRIVATE PROPERTY - Any realty or personal property or interest privately owned and situated within the borders of the unincorporated Town of Eastchester.
PUBLIC PROPERTY - Any realty or personal property or interest therein owned by the Town of Eastchester, including all streets, parks and public places, lands, lands underwater, waterfront property, and every estate, interest and right, legal or equitable, therein.
Section 4. License Required.
No person, firm, corporation, organization or business entity shall commence filming as defined herein, in the Town of Eastchester on public or private property, unless the filming to be conducted, maintained or operated is licensed in the manner prescribed herein.
Section 5. Application for License; Issuance, Expiration.
The license prescribed by this Local Law shall be issued by the Town Clerk after review and approval from the Chief of Police and the Town Attorney and/or his/her designated agent. Application shall be made on a form containing such information as may be determined by the Town Board, and shall be accompanied by the production schedule, schedule and description of all dangerous activities and use of explosives, and list of all vehicles and their license plate numbers, to include both the applicant's vehicles and vehicles of the applicant's personnel. Each license shall expire on the date set forth on the license. Applications shall be filed in the Office of the Town Clerk.
Section 6. Approval by the Chief of Police and the Town Attorney.
No license shall be issued until the application has been approved by the Chief of Police and the Town Attorney and/or his/her designated agent, subject to the following:
A. In the approval of the application, the Chief of Police, Town Attorney, and/or his/her designated agent shall specifically fix the filming location or locations.
B. In the approval of the application, the Chief of Police, Town Attorney, and/or his/her designated agent shall specifically fix the days and hours of filming.
C. The Chief of Police, Town Attorney, and/or his/her designated agent may deny any application or limit any license, which, in his/her judgment, would conflict with other scheduled events in the area of the filming location, would be detrimental to the community because of anticipated excessive noise, illumination, traffic disruption or other effect caused by the proposed filming, including but not limited to the use of explosives, or would unduly interfere for an extended period of time with the day-to-day activities of citizens, property owners or merchants or would interfere with the public health, safety and welfare of the Town's citizens.
The fee to be paid shall be determined by the Town Attorney and Chief of Police for each license, including a license for a portion of a day, as follows:
A. License fee for use of public property and/or private property. The minimum fee shall be $50. per day, and the maximum fee shall not exceed $5,000. a day. The Town Attorney and Town Clerk, in determining the specific fee to be required, shall take into consideration the following factors which would denote a greater use of public property and therefore require higher fees:
(1) Use of public parking spaces.
(2) Use of vehicle travelways requiring the rerouting or directing of pedestrian traffic.
(3) Use of pedestrian travelways requiring the rerouting or directing of pedestrian traffic.
(4) Use of public buildings.
(5) Use of other public areas during normal operating hours.
(6) The size of the filming location.
(7) The number of filming locations.
(8) The number of hours the filming location or locations will be used.
(9) Use of involvement of Town personnel.
(10) Use or involvement of Town equipment.
(12) Dangerous activities.
(13) Level of disruption of peaceful enjoyment of neighboring property.
B. The Town of Eastchester and the Eastchester Union Free School District and not-for-profit community agencies operating within the Town shall be exempt from such license fee, but must obtain a permit.
C. In the event that a license issued to this Local Law is suspended or revoked in accordance with the provisions of Section 8 of this Local Law, the applicant shall not be entitled to a refund of any portion of the fee.
Section 8. Suspension or Revocation of License.
A. The Chief of Police, Town Attorney and/or Town Clerk, on his/her own initiative or upon notice from any public official of the Town, is empowered to suspend or revoke, upon written notice, a license issued pursuant to this Local Law for any of the following reasons:
(1) Violation by the licensee agents, employees, contractors or subcontractors of any law or ordinance or any rule or regulation of any agency of the state, county or town.
(2) Licensee has permitted disorderly conduct or conduct detrimental to health and safety of others or permitted or allowed conduct constituting a breach of the public peace at the licensed location.
(3) Abrogation of any agreement, written or oral, between the licensee and the Chief of Police, Town Attorney, Town Clerk or any other public official of the Town.
B. Revocation of license pursuant to the above conditions shall bar such offender from applying for a new license within one year from the date of revocation.
Section 9. Restrictions and Requirements.
A. The licensee must give notice to residents of the proposed filming location in the manner specified by the Town Attorney, Town Clerk and/or his/her designated agent.
B. Noise shall be limited in accordance with the provisions of Local Law No. 1 - 2001, a local law to promote the Health, Safety and General Welfare of the Town of Eastchester and its inhabitants by prohibiting unnecessary and unusual noises.
C. Routing of traffic shall be subject to the same provisions as excavations in the provisions of Local Law No. 11 - 2002, a local law known as “The Street and Sidewalk Excavation Law” of the Town of Eastchester.
D. The filming shall be conducted so as not to interfere with access to fire lanes and fire hydrants. Equipment, materials or obstructions shall not be placed within 15 feet of fire hydrants. Passageways leading to fire escapes, fire lanes and fire-fighting equipment shall be kept free of equipment, materials or obstructions. Parking spaces for the handicapped shall be kept free of equipment, materials or obstructions.
E. A filming permit granted for private property shall confine such filming to that property.
F. Applications for a filming permit must be submitted five days prior to the first date of filming.
G. Any additional costs that are incurred by the Town by reason of the filming, shall be borne by the licensee. Any requirement for the assignment of Town personnel shall be determined by the Chief of Police prior to the filming.
Section 10. Insurance and Bond.
The license shall not be issued until the applicant furnishes a policy of insurance as follows:
The Licensee shall provide proof of the following coverage (if additional coverage is required for a specific agreement, those requirements will be described in the "Special Conditions" of the contract specifications):
(a) Workers' Compensation. Certificate form C-105.2 or State Fund Insurance Company for U-26.3 is required for proof of compliance with the New York State Workers' Compensation Law.
State Workers' Compensation Board form DB-120.1 is required for proof of compliance with the New York State Disability Benefits Law. Location of operation shall be "All locations in Westchester County, New York."
(Where an applicant claims to not be required to carry either a Workers' Compensation Policy or Disability Benefits' Policy, or both, written confirmation is required to be submitted as proof of The Town of Eastchester and a temporary permit may be issued if the employer completes form C-105.2 in duplicate. A copy of form C-105.2 is sent to the Worker's Compensation Board, Information Unit for investigation and report.)
If the employer is self-insured for Worker's Compensation, the employer should present a certificate from the New York State Worker's Compensation Board evidencing that fact.
(b) Employer's Liability with minimum limit of $100,000.
(c) General Liability Insurance with a minimum limit of liability per occurrence of $2,000,000 for bodily injury and $500,000 for property damage or a combined single limit of $2,000,000 (c.s.l), name the Town of Eastchester as an additional insured. This insurance shall indicate on the certificate of insurance the following coverages:
(i) Premises - Operations.
(ii) Broad Form Contractual.
(iii) Independent Contractor and Sub-Contractor.
(iv) Products and Completed Operations.
All Contracts involving the use of explosives and demolition shall provide the above coverage with elimination of the XCU exclusion from the policy, or proof that XCU is covered.
(d) Automobile Liability Insurance with a minimum limit of liability per occurrence of $2,000,000 for bodily injury and a minimum limit of $200,000 per occurrence for property damage or a combined single limit of $2,000,000 unless otherwise indicated in the contract specifications. This insurance shall include for bodily injury and property damage the following coverages:
(iii) Non-owned automobiles.
(e) All Applicants are also required to provide an Owner Contractor Protective (“OCP”) Policy in the amount of $1,000,000 general liability limit in the name of the Town of Eastchester.
3. All policies and certificates of insurance of the Applicant shall contain the following clauses:
(a) Insurers shall have no right to recovery or subrogation against the Town of Eastchester (including its employees and other agents and agencies), it being the intention of the parties that the insurance policies so effected shall protect both parties and be primary coverage for any and all losses covered by the above-described insurance.
(b) The clause "other insurance provisions" in a policy in which the Town of Eastchester is named as an insured, shall not apply to the Town of Eastchester.
(c) The insurance companies issuing the policy or policies shall have no recourse against the Town of Eastchester (including its agents and agencies as aforesaid) for payment of any premiums or for assessments under any form of policy.
(d) Any and all deductibles in the above described insurance policies shall be assumed by and be for the account of, and at the sole risk of, the Contractor.
The Licensee shall indemnify and save harmless the Town of Eastchester, its officers, agents and employees from and against any claim, loss or damage resulting from the filming operations permitted under this license in the Town of Eastchester and for the payment of all damages for bodily injury or property damage which may be caused to any person by reason of the filming operations performed under the license and arising from any acts or omissions of the licensee, his agents, employees, contractors or subcontractors. In addition, the applicant must produce certificates of insurance showing adequate liability insurance in the applicant's name, naming the Town of Eastchester as additional insured. Such certificates shall also be approved the Town Attorney.
Section 11. Penalties for Offenses; Additional Remedies.
Any person, firm or corporation who shall violate or fail, neglect or refuse to comply with any provision of this Local Law or any rule or determination made thereunder, or who shall undertake filming in the Town of Eastchester without a license issued hereunder, shall, upon conviction thereof, be punished by a fine of not less than $500 per day of illegal filming and not more than $10,000 per day of illegal filming.
This Local Law shall be enforced by the Police Department.
If any word, clause, sentence, paragraph, subdivision or part of this local law shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder hereof, but shall be limited in its application to the word, clause, sentence, paragraph, subdivision or part hereof directly involved in the controversy in which such judgment shall have been rendered.
Section 14. Superseding Other Laws
All ordinances or parts of ordinances or local laws or parts of local laws, or State laws which conflict with the provisions of this local law are hereby superseded and rendered temporarily null and void to the extent necessary to give this local law full force and effect, pursuant to Article 2, Section 10 of the New York State Municipal Home Rule Law.
Section 15. Effective Date
This local law shall take effect immediately upon filing with the Office of the Secretary of State.

OPPORTUNITY TO ADDRESS THE BOARD ON AGENDA ITEMS
Manfred Moses, 29 Huntley Road, suggested that a Regional Hazard Mitigation Plan be developed for the area in addition to the Town's Plan. Mr. Moses distributed two articles to the Town Board that reported a chemical release of chlorine gas and the necessary evacuation of the surrounding area in Kearny, New Jersey.

Supervisor Colavita offered a motion that was seconded by Councilwoman Ford to re-appoint Mark Davis, 24 Ridge Road, to the Lake Isle Advisory Board (tennis) for the term effective October 5, 2005 - September 30, 2007.

B) APPOINTMENT - LAKE ISLE ADVISORY BOARD
Councilwoman Marcotte offered a motion that was seconded by Councilwoman Ford to re-appoint James McFadden, 101 Lakeview Avenue, to the Lake Isle Advisory Board (swimming) for the term effective October 5, 2005 - September 30, 2007.

C) APPOINTMENT - LAKE ISLE ADVISORY BOARD
Supervisor Colavita offered a motion that was seconded by Councilman Cacciola to re-appoint Nick Saviano, 84 Howard Avenue, to the Lake Isle Advisory Board (golf) for the term effective October 5, 2005 - September 30, 2007.

Councilwoman Ford offered a motion that was seconded by Supervisor Colavita to approve the Town Board Meeting Minutes of September 20, 2005 as prepared by Town Clerk Linda Doherty and to approve the Minutes of the Special Town Board Meeting on the Hazard Mitigation Plan of September 22, 2005 as prepared by Deputy Town Clerk Kathleen Meyerherm.

RESOLUTION AUTHORIZING THE SETTLEMENT OF A CLAIM BY LEONARD BANACH
Supervisor Colavita offered a motion that was seconded by Councilman Cacciola to approve a RESOLUTION authorizing the settlement of a claim by Leonard Banach against the Town of Eastchester in the amount of $500.00 for damages sustained to Mr. Banach's automobile when a Town tree accidentally fell on said vehicle when a Town worker was trimming it. Said amount represents Mr. Banach's deductible.

C. Mill Road for $11,179.58, Sleepy Hollow Realty Corporation for $49,711.11, Elide Enterprises for $5,421.30, Leewood Associates for $65,361.91, and D & E DeGaetano for $7,074.02.

Superintendent of Highways Bonhag reported that work performed under our 2005 Street Resurfacing Project is complete. Crosswalks and stop bars on newly resurfaced roadways will be repainted within the next couple of weeks. Work under this contract should be complete by mid October.
Crews continued pothole maintenance and rebuilt various catch basins throughout the Town. Curbstones were raised on Scarsdale Avenue at the intersection of Anderson Avenue and the intersection of New Rochelle Road & Lockwood Avenue. In addition, crews began to raise the curbstones on Dunwoodie Street, between Woodruff & Alkamont on the Park side.
Crews repaired the wooden guard rail on Highland Avenue and the handicap ramp at the American Legion Post, on Ackerman Place.
Further, the shrubbery and fence that divided the Highway Yard and Labriola Field was removed. A new fence will be installed by the TYA.
In order to get an early start on leaf pickup we will be sending out one leaf machine on Thursday, September 29, 2005, to remove sporadic leaf piles throughout the Town. In order to assist with leaf pickup we will be hiring five additional seasonal workers for a total nine Laborers.

C) MEMORANDUM FROM TOWN CLERK RE: ELECTION INSPECTOR WAGES
Per a request from Town Clerk Linda Doherty, Councilwoman Ford offered a motion that was seconded by Supervisor Colavita to increase the hourly wage of Election Inspectors from $10. per hour to $11. per hour for the November 8, 2005 election.
Funds are available in the 2005 Budget.
Councilwoman Ford spoke in support of increasing the salary of the Election Inspectors and thanked the Inspectors for the job that they do for the Town.
Town Clerk Linda Doherty reviewed the preliminary plans for the County Board of Elections to assume ownership of the Town's voting machines and for the transfer of the Town's election-related responsibilities to the County. Mrs. Doherty indicated that the final plans would be presented to the Town by the County Executive's Office and would be discussed at a future meeting.

D) MEMORANDUM FROM SUPERVISOR RE: GOLD STAR MOTHERS - MEMORIAL PARK
Supervisor Colavita offered a motion that was seconded by Councilwoman Marcotte to approve a resolution to support and authorize the installation of a Gold Star Mother's Monument at Memorial Park.
Councilwoman Ford spoke in support of the monument and stated its appropriateness as the community of Eastchester/Tuckahoe/Bronxville lost more soldiers, per capita, then did any other during World War II. A total of 131 men were lost in action.

E) MEMORANDUM FROM SUPERVISOR RE: HOLIDAY DECORATIONS
Per a request from Supervisor Colavita, Councilwoman Ford offered a motion that was seconded by Councilman Cacciola to approve the sale of 78 Holiday Snowflake Silhouette decorations to the City of White Plains for the amount of $3510.00.
Supervisor Colavita explained the money would be used to purchase new holiday decorations in consultation with the Eastchester Beautification Committee.

F) MEMORANDUM FROM BUILDING INSPECTOR RE: SIGN ORDINANCE ENFORCEMENT

G) MEMORANDUM FROM COMPTROLLER RE: HIGHWAY PERSONNEL ISSUES - EXECUTIVE SESSION
Supervisor Colavita offered a motion that was seconded by Councilwoman Ford to enter into Executive Session after the Second Opportunity to Address the Board.

MISCELLANEOUS BUSINESS - none
Councilwoman Ford encouraged residents to participate in the Tour of Eastchester Historic Places being offered by the Eastchester Historical Society. The Society's President, Mike Fix, and the Town Historian, Richard Forliano, act as tour guides and educators on the bus trip through Town.
Councilman Cacciola reminded residents that the applications for the Eastchester Instruction Basketball League (EIBL) had recently been mailed. Mr. Cacciola encouraged all who were interested to complete and return the applications to the Recreation Department.
Councilwoman Marcotte announced the Friends of the Library Book Sale to be held October 21 - 24 at the Library. Donations of books, tapes, books-on-tape and DVDs would be accepted beginning October 11th.
Mrs. Marcotte congratulated Tracy Wright on the 8th anniversary of the very successful program, The Adult Mystery Club.
In closing, Mrs. Marcotte announced the upcoming Annual Health Fair to be held on October 19th and the Nutrition Center Health Fair to be held on October 26th.
Supervisor Colavita congratulated Captain Bonci and the members of the Police Department for the arrest of two individuals for burglary which occurred after a resident called the Department with a report of suspicious behavior.
SECOND OPPORTUNITY TO ADDRESS THE BOARD
Vivian Zelvin, 3 Douglas Place, presented the Town Board with a petition of 396 signatures requesting the Town Board to consider an expansion of the Eastchester Public Library. Mrs. Zelvin asked that the petition be added to one previously submitted that contained 345 signatures.
Peter DeFelice, 24 Channing Place, asked for an update to the Haindl Field project and asked if approval is required by the NYS Comptroller. Supervisor Colavita explained that no approval was necessary by the State Comptroller, but did remind Mr. DeFelice that the State DEC had approved the project. Supervisor Colavita reported that he thought the contract for the project would be completed prior to the next Town Board Meeting.
Mr. DeFelice stated that he had attended a Bronxville Village Board Meeting, held to discuss reassessment within the Village. Town Assessor Richard O'Donnell's work within the Town and Village of Bronxville cited throughout the meeting, was reported to be complete and accurate.
Charlie Galanak, 21 Potter Place, made several suggestions with regard to Haindl Field, specifically, that advertising on the score board and in the park be sold to offset the costs and that the Town Board consider locating a Town Community Center to the site.
Supervisor Colavita thanked Mr. Galanek for his ideas and indicated that many sites have been reviewed as a possible site for a Community Center; however, the area at Haindl Field would not be large enough. Supervisor Colavita spoke in support of the Community Center being located in the Town Center, adjacent to a renovated Library. Supervisor Colavita indicated that a parking and traffic study would need to be completed to provide ample parking in the area.
Supervisor Colavita stated the Town Board's commitment to build a Community Center and to find a location for a teen center to be used prior to the construction of a Community Center. Supervisor Colavita also announced that a teen survey would be sent to our High Schools to help determine the wants and needs of our teen population.
Fred Moses, 29 Huntley Road, spoke in opposition of locating a Community Center adjacent to the Library as the Library is located on property that is “Town-outside” and a Community Center should be located on Townwide property.
Mr. Moses reiterated his request for a “townhall” meeting with State representatives to discuss alternative sites for the United Water Treatment Plant. Supervisor Colavita committed to continue to fight the efforts to build the plant on California Road and indicated that the Town's State representatives are aware of the public outcry to have the plant relocated.
There being no further business, the Town Board adjourned into Executive Session at 9:35 p.m. Supervisor Colavita indicated that the Town Board would return to take action and would adjourn the meeting with a moment of silence for Bronxville resident Hector Hyacinthe.
The Town Board, Town Attorney John Sarcone and Comptroller Ann Marie Berg moved into Executive Session to discuss Highway Personnel Issues.
The Town Board returned at 10:25 p.m. to take action on Agenda Item 10G and moved out of Executive Session.
The following resolution was offered by Supervisor Colavita and seconded by Councilwoman Marcotte:
WHEREAS, Peter W. Bonhag (“Bonhag”) is employed by the Town as Superintendent of Highways, Buildings and Grounds; and
WHEREAS, on September 28, 2005 disciplinary charges were preferred against Bonhag pursuant to Section 75 of the New York Civil Service Law; and
WHEREAS, pursuant to Section 75 of the New York Civil Service Law the Town has the authority to suspend an employee pending the determination of disciplinary charges for a period not exceeding thirty (30) days; now, therefore,
BE IT RESOLVED, that Peter W. Bonhag hereby is and shall be suspended, without pay, for thirty (30) days commencing on October 6, 2005; and
BE IT FURTHER RESOLVED, that Bonhag shall not be permitted to use any Town property during said suspension, including but not limited to the vehicle and mobile phone made available to him by the Town for the performance of his duties, and he shall be required to deliver all Town keys and property to the Town Comptroller by no later than 9:00 a.m. on October 6, 2005.
On the roll call, all voted "AYE," except Councilman DelVecchio who was ABSENT. Motion carried.
