they are expecting Mr. Cermele but he is

10 running late.

APPLICATION 07-58, 31 STEWART PLACE

13 Mr. Salerno: Rocco Salerno, attorney for

the applicants Robert and Helen Reese. States

14 property is located in an R-5 zone, consists of

approximately twenty-two thousand six hundred

15 and ninety-two square feet. Describes lots.

States applicant is proposing a minor

16 re-division of the boundary line between lots

9.1 and 9.2. States easterly boundary line

17 would be moved two point one nine feet to the

west and northerly boundary line would be moved

18 eighteen point three eight feet to the south.

Explains this permits the applicants to create

19 a third lot which complies with the zoning code

with respect to lot area and would reduce the

20 size of the existing lot 9.2 to seven thousand

five hundred and five square feet which renders

21 lot 9.2 more in keeping with the character of

the neighborhood. States proposed lot 9.3

22 would consist of seven thousand five hundred

and six square feet fronting on Stewart Place.

23 Explains a minor variance for the effective

square of the proposed new lot 9.2 and a minor

24 variance for the gross floor area of the

existing three family dwelling on lot 9.1 were

25 granted by the Zoning Board of Appeals. States

to address the Zoning Board's concerns

regarding parking and density this proposal

2 includes converting the three family dwelling

to a two family dwelling.

Ms. Uhle: States application is here for

4 subdivision and re-division. Explains as a

condition of the Zoning Board approval, which

5 she would recommend it be a condition of the

Planning Board approval, the Zoning Board

6 indicated that the existing three family

residence located on tax lot 9.1 shall be

7 converted to a two family residence. The final

subdivision plat shall not be signed by the

8 Chairman of the Planning Board or filed with

the office of the County Clerk until a

9 Certificate of Compliance has been issued for

the conversion. States a second condition is

10 the time period for the expiration of the

variance under Section 10.H of the zoning law

11 shall run from the date of the Planning Board

Chairman signing the subdivision plat

12 constituting final subdivision approval in

accordance with Section 10.H.1.2.

Mr. Bonanno: Makes a motion to open the

14 public hearing on Application 07-58, 31 Stewart

Place.

are seeing will be implemented.

Ms. Uhle: States yes.

Mr. Pulaski: Asks if they can put shrubs

24 between that driveway and the new adjoining

lot.

that. Explains the only problem is within a

2 three foot area you're very limited to what you

could plant.

Mr. Pulaski: Suggests putting in a low

4 shrub cover.

5 The Chairman: Asks that the applicant

submit a planting plan to the building

6 department showing landscaping to add some

visual break to a twenty-two foot wide sea of

7 asphalt and whatever Ms. Uhle finds suitable is

fine.

Entertains a motion to declare a negative

9 declaration under SEQRA for Application 07-58.

10 Mr. Pulaski: Seconds motion.

12 The Chairman: Entertains a motion for

approval of Application 07-58 with the

13 conditions of the plantings and the curb cut

being fixed only on the existing lot that will

14 be transferred from three to two family and the

conditions that Ms. Uhle just read.

18 APPLICATION 07-67, 737 WHITE PLAINS ROAD

Mr. Chirigianis: Steven Chirigianis,

20 architect for the applicant. States they were

here a few months ago and certain requirements

21 were made for changes. States he had two

meetings with Ms. Uhle and all the changes that

22 were requested were made. Explains they

reduced the size of the project and reduced the

23 number of required parking spaces. Explains

they reconfigured the location of the trash

24 containers; they put an eighteen foot driveway

entrance; they show the sections on detail B

25 for the retaining wall.

Ms. Uhle: Explains they also increased

2 the driveway width to twenty-five feet for the

back up aisle width and provided the four foot

3 wide sidewalk that was requested.

4 The Chairman: Asks if there is anything

outstanding in terms of drainage.

Ms. Uhle: Explains the applicant did

6 retain an engineer and the town has retained an

engineer. Explains that is still in progress.

7 States she would feel comfortable making that a

condition of approval if the board is at that

8 point.

9 Mr. Pulaski: Asks about the retaining

wall.

Ms. Uhle: Explains applicant decided to

11 build their own wall so they are not dependant

upon the wall that's on the other property.

12 States applicant indicated he does not feel

comfortable with the bollards adjacent to the

13 sidewalk and also the board had required a

guardrail at the rear property line, the plan

14 still shows the guardrail but that is when the

pavement went all the way up to the back.

The Chairman: States bollards are in

16 front of the curb and not on top of the curb

where they should be. States he would cut the

17 number of them in half. Feels they should put

them around the handicapped ramp.

Mr. Chirigianis: Asks if he is

19 suggesting two at the top of the ramp.

20 The Chairman: States yes. Suggests

putting two at the top of the ramp and two at

21 the center line of five and six and two at the

center line of one and two. Asks about the

22 traffic issue.

23 Ms. Uhle: States prior to the issuance

of the building permit they would need DOT

24 approval for the curb cut.

25 Ms. Cascione: Asks about guardrail in

the back.

Ms. Uhle: Explains applicant does not

3 think it's necessary now that the pavement is

moved away from the wall. Explains the grade

4 goes down and there is a wall and a fence on

top of the wall. States the question is

5 whether that guardrail is still necessary.

6 The Chairman: Feels if there is a five

or six foot separation from the curb to the

7 wall that's ample room and they don't need the

guardrail there now.

Mr. Pulaski: Asks if they could fit

9 shrubs in there.

10 The Chairman: Asks that they submit a

planting plan that fills in all the missing

11 teeth along the westerly side and something in

the front.

Asks if anyone from the public would like

13 to comment on the application.

15 The Chairman: Makes a motion to close

the public hearing on Application 07-67, 737

16 White Plains Road.

17 Mr. Pulaski: Seconds motion.

19 Mr. Chirigianis: States their engineer

is here and they can show the drainage.

Engineer: Shows site plan. States they

21 developed a site plan that is going to

incorporate full on site detention of all the

22 water and sheet flow off the building and off

the paved services. States they have ten

23 thousand gallons of storage capacity. States

they did sidewalk details with respect to the

24 DOT regulations. States they have the pavement

details, sidewalk details and the information

25 that's required for site plan approval.

The Chairman: Asks if they have perc

2 tests to back up the data.

3 Engineer: States yes.

4 The Chairman: Asks if there is a drain

inlet within the trash enclosure.

Engineer: Explains they don't have it,

6 but if that's a requirement of the board it's

simple to do that.

The Chairman: States he would do that.

8 Asks if there is any lighting.

9 Mr. Chirigianis: States lighting would

be on the face of the building.

The Chairman: Entertains a motion to

11 declare a negative declaration under SEQRA for

Application 07-67, 737 White Plains Road.
