3 everybody. Welcome to the June 13th
4 meeting of the Zoning Board of Appeals.
5 Would everybody please stand for the
7 (Whereupon the Pledge of Allegiance
9 THE CHAIRMAN: The first item of
10 business for the Board will be to approve
11 the minutes from our meeting on May 9th.
12 Is there a motion to approve those
14 MR. SALANITRO: Make that motion.
15 THE CHAIRMAN: Moved by Mr.

23 As we do each month, what I'll do
24 is run through the agenda. As everybody
25 in the audience can see, we have a Board

2 of four tonight. I believe that most, if
3 not all, of the applicants were advised
4 in advance that we would have a Board of
5 four tonight. What that means is if
6 you're an applicant and you decide to
7 proceed tonight and end up with a two/two
8 vote, that would be the equivalent of a
9 denial. You need three out of the four
10 sitting members to vote in favor of an
11 application to get an approval. If you
12 didn't get that message ahead of time and
13 decide now to ask for an adjournment,
14 that's perfectly fine. We
15 unfortunately -- well, fortunately for us
16 unfortunately for you we don't meet again
17 until September, so you need to factor
18 that in. But you certainly would have an
19 opportunity now to say I would prefer to
20 wait to have a full Board, because in
21 reality with a Board of four you already
22 have one no vote against you because
23 there's somebody not voting.
24 The reason we have a four member
25 Board, for those that don't know, is that

2 our fifth member, Michael Cahalin, was
3 appointed to the Town Board just a few
4 weeks ago. For those of you that don't
5 know Mike or haven't seen Mike in action,
6 he was an extremely dedicated member of
7 our Board. He was very passionate about
8 what he did. He liked to express his
9 opinion and that was always very helpful
10 with respect to the application he spoke
11 about, because he would offer a
12 perspective that some of the other
13 members wouldn't have. He would say it
14 in a very forceful and passionate way and
15 I certainly and I'm sure the rest of the
16 Board members are going to miss Mike very
17 much and we certainly wish him well on
18 the Town Board. So, that's the situation
19 we confront tonight having a Board of

22 anything else about Mike, then I could go

3 we do each month, I'm going to run
4 through the agenda, and for people who
5 are here or watching at home there have
6 been a number of adjournments because of
7 the four member Board. For those of you
8 that are here tonight intending to go
9 forward, please let me know that you are
10 going to proceed and please let me know
11 that you are comfortable proceeding with
12 a four member Board. And again, if you
13 want an adjournment that's absolutely
14 fine, it's your right to hope that by
15 September we have a five person Board,
16 which I would expect we would.

9 White Plains Road. For anybody
10 interested in that one, that one has been
11 adjourned. It will be on the agenda for
12 our meeting in September, which is the
13 second Tuesday of September and you will
14 not get a further notice for that
15 meeting, so you just need to follow the
16 agenda into September.

6 The adjourned items tonight besides
7 the one I mentioned, 737 White Plains
8 Road, are: 138 Woodruff Avenue, 31
9 Stewart Place and 196 Oakland Avenue.
10 All of those have been adjourned until
11 September, and as I said before with
12 respect to 737 White Plains Road, you
13 will not receive another notice in the
14 mail about the public hearing for any of
15 those, they will just be carried onto the
16 September agenda without another mailing
17 going on. If you're interested in those
18 applications, you need to follow the
19 agenda and it's the second Tuesday in
20 September and we start at seven thirty.
