2 THE CHAIRMAN: Welcome to the April

3 8th meeting of the Zoning Board of

4 Appeals. Would everybody please stand

5 for the Pledge of Allegiance.

6 (Whereupon the Pledge of Allegiance

7 was said.)

8 THE CHAIRMAN: The first item of

9 business will be the approval of the

10 minutes from the March 11th meeting. Is

11 there a motion it approve the minutes?

12 MR. BORDUCCI: So moved.

13 THE CHAIRMAN: Moved by Mr.

14 Borducci. Is there a second?

15 MR. BAKER: Second.

16 THE CHAIRMAN: Second by Mr. Baker.

17 All in favor.

18 (All aye.)

19 THE CHAIRMAN: The minutes of the

20 March meeting have been approved.

21 Tonight's agenda has five items.

22 I'll just run through the agenda quickly

23 to see if there is a representative here

24 for each applicant. If there is a

25 representative here, please let us know

2 if you are prepared to proceed tonight.

3 If you're not, let us know that as well

4 so the people at home or people here will

5 not be sitting through an entire agenda

6 just to find out later that you're not

7 going to proceed.

8 First item is the only item under

9 old business, it's Application 08-14, 490

10 - 498 New Rochelle Road. Mr. Bauman is

11 here for the applicant, and you are

12 prepared to proceed?

13 MR. BAUMAN: Yes, we are.

14 THE CHAIRMAN: They're going to

15 proceed. We go to the new business

16 agenda. First one is 08-01, 37

17 Hutchinson Boulevard. Is somebody here

18 on that one?

19 MR. DEL COTTA: Yes.

20 THE CHAIRMAN: Mr. Del Cotta. And

21 you're going to proceed tonight?

22 MR. DEL COTTA: Yes.

23 THE CHAIRMAN: That one is going to

24 proceed. Next one is Application 08-19,

25 1 Webster Road, and the applicant is

2 here. Are you prepared to proceed?

3 APPLICANT: Yes.

4 THE CHAIRMAN: That one will

5 proceed as well.

6 Next one is 08-20, 12 Alta Drive.

7 Is somebody here on that application?

8 This gentleman here. And you're prepared

9 to proceed?

10 APPLICANT: Yes.

11 THE CHAIRMAN: That one will go

12 forward. The final one will be

13 Application 08-21, 9 Bronson Avenue. Is

14 somebody here on that? Gentleman in the

15 back. And you're ready to proceed?

16 APPLICANT: Yes.

17 THE CHAIRMAN: That one will go

18 forward tonight at well. The entire

19 agenda will proceed tonight. There are

20 three adjourned items. First one is

21 Application 07-58, 31 Stewart Place.

22 That has been adjourned to the May 13th

23 meeting, which is our next meeting. The

24 next one is 07-92, 85 Tuckahoe Avenue,

25 also adjourned to the May 13th meeting,

2 and the final one on the adjourned agenda

3 is 08-10, 165 Oakland Avenue. That one

4 at this point has just been adjourned for

5 additional information. We're not one

6 hundred percent clear if it's going to be

7 on in May or not.

8 MS. UHLE: That's correct.

9 THE CHAIRMAN: If anybody is

10 interested or would like to follow those

11 applications, the Stewart Place one and

12 Tuckahoe Avenue should be on the agenda

13 in May. The Oakland Avenue what you will

14 need to do if you're following that one

15 is contact the building department as we

16 approached the May 13th meeting and you

17 can find out if that's going to be on the

18 agenda or not or you can follow the

19 agenda from the town's website and you

20 will find out if that is going to be

21 heard in May or sometime thereafter. For

22 the adjourned applications you're not

23 going to receive another notice in the

24 mail, a green card telling you that the

25 meeting is set for a certain night. When

2 they're on the adjourned agenda as they

3 are, they just proceed to the next

4 monthly meeting without another card

5 going out. So, don't expect another card

6 for those items.

7 We're ready to go to the agenda

8 tonight. First application is

9 Application 08-14, 490 - 498 New Rochelle

10 Road. Mr. Bauman.

11 MR. BAUMAN: Good evening, Mr.

12 Chairman, members of the board. A little

13 housekeeping first. I have two

14 additional green cards that I'll turn in

15 to the office and I also finally got the

16 Affidavit of Publication in the Journal

17 News, so I'll submit that also for the

18 file.

19 I'm not going to go through the

20 case again. You adjourned this matter

21 for all purposes, but the main reason was

22 so that you could receive from the town

23 of Eastchester Police Department a report

24 concerning the meters that are located in

25 the immediate area of the subject

2 property, which is 490 - 498 New Rochelle

3 Road and you did receive that letter, I

4 assume, Mr. Chairman. Are you going to

5 be reading that or do you want me to? I

6 received a copy of it this afternoon, but

7 I ask whether you wish to read that.

8 THE CHAIRMAN: If you want to

9 characterize it, that's fine.

10 MR. BAUMAN: I'm just going to

11 characterize it by saying that we

12 received pursuant to the board's

13 instructions a letter from Lieutenant

14 Jeffrey W. Hunter who had the area of New

15 Rochelle Road in Chester Heights checked

16 with respect to the meters on two

17 occasions during the weekdays between the

18 last board meeting and tonight and in

19 that letter he showed a parking study

20 where all of the meters, there are

21 sixty-three meters in total that they

22 counted in the area, Alta Drive, New

23 Rochelle Road, Hillcrest, Parkway Plaza,

24 Oregon Avenue, Parkway Plaza, Hillcrest

25 Road, sixty-three total. The average
