7 THE CHAIRMAN: The first item of
8 business is the approval of our minutes
9 from the April 8th meeting. Is there a
10 motion to approve the minutes?
11 MR. BORDUCCI: So moved.
12 THE CHAIRMAN: Moved by Mr.
15 THE CHAIRMAN: Second by Mr. De
18 THE CHAIRMAN: I'll run through the
19 agenda quickly. If the applicant or
20 their representative is here and is
21 prepared to proceed, please let us know.
22 If you're not going to proceed, please
23 let us know that as well so we can tell
24 anybody watching at home or anybody here
25 tonight that your application is not
1 EASTCHESTER ZBA - 5/13/08
2 going forward so they don't spend the
3 entire evening with us.
4 First application under old
5 business is 31 Stewart Place. Mr.
6 Allocco is here for the applicant and
7 they're ready to proceed.
8 Second item under old business is 1
9 Webster Road. I see the applicants are
10 here and you're ready to proceed? They
12 Moving to new business, the first

14 somebody here on that application?
15 They're ready to proceed on that.
16 Next one is 1 Hickory Hill Road.
17 Is somebody here on that? Yes, the

2 that. You're ready to proceed, correct?
4 THE CHAIRMAN: There are a number
5 of adjourned items. They are 165 Oakland
6 Avenue, that has been adjourned for
7 additional information. You'll need to
8 follow our agenda to see if it's on the
10 MS. UHLE: Otherwise it will be
11 re-noticed. We'll require they re-notice
12 if it's not on the June agenda.
13 THE CHAIRMAN: If it's not on the
14 June agenda, Ms. Uhle from the building
15 department has advised they will be
16 required to re-notice, which means it
17 will be published in the newspaper again,
18 which nobody sees any way, but you will
19 also receive a letter in the mail
20 certified mail return receipt requested.
21 So, if you're interested in the Oakland
22 Avenue one or any of the other ones, I'm
23 about to say you will receive
24 notification if they're not on the June
25 agenda. So, if you are interested in any
1 EASTCHESTER ZBA - 5/13/08
2 of these, follow at least the June agenda
3 to see whether they will be back or not.
4 After June we don't meet again until
6 Next adjourned item is 85 Tuckahoe
7 Avenue, the next one is 144 Gaylor Road,
8 and the final one is 26 Arlington Road.
9 Those four applications have been
10 adjourned for tonight.
11 We can go to the first item on the
12 agenda which is Application 07-58, 31
13 Stewart Place. Mr. Allocco.
14 MR. ALLOCCO: Good evening, Mr.
15 Chairman, members of the board. For the
16 record, my name is Chris Allocco. My
17 office is at 8 Roy Place here in
18 Eastchester. And also, in case it has
19 not been communicated to you, I was
20 engaged on this application this morning.
21 What I'm going to go through for the new
22 members who haven't seen this one,
23 because it's got somewhat of a life of
24 its own, will be a little bit for my own
25 benefit as well. I understand this one
1 EASTCHESTER ZBA - 5/13/08
2 has not been before you for several
3 months. With me, by the way, is Mr.
4 Reese. He is sitting back in the corner
5 in case there are any questions that are
6 more specific than I would be able to get
8 We're in the middle of a revision.
9 We were hoping to move a lot line and
10 create what I'll call a third lot from
11 what was the original lot nine. The
12 first subdivision has already taken
13 place. We created lots nine point one
14 and nine point two and what we're looking
15 to do now is in essence create a nine
16 point three, which is rather than say
17 north and south it's easier for me to say
18 to the right of lot nine point one which
19 is where the existing three family house
21 There are two matters before you,
22 and I don't know to what extent the first
23 one has been resolved, but the first,
24 which is whether this is deemed a
25 rehearing or whether it's a new
1 EASTCHESTER ZBA - 5/13/08
2 application, I'll submit, as I'm sure Mr.
3 Salerno has submitted in the past, that
4 this is a new application, and I can
5 explain to you why I would like to make
6 that argument unless you're already
7 convinced of that point.
8 Certainly, to build up the record,
9 the prior attempt to come in and put a
10 lot over there was basically to put a
11 fifty-six hundred square foot -- I'm
12 going to put a second board up for you
13 now -- this was the prior look. If you
14 look at the nine point three, that was
15 intended to be a lot. As you can see,
16 for a seven point five zone it's
17 significantly substandard in area, it did
18 not offer the effective square and also
19 in leaving the three family structure as
20 we initially tried to do where the
21 existing house is there was a need for a
22 parking variance as well. Also, there
23 were several variances that were required
24 at that point but what was most important
25 at the time was the fact that we were
