2 THE CHAIRMAN: Good evening,

3 everyone. Welcome to the Zoning Board of

4 Appeals meeting for March 11, 2008.

5 Would everybody please stand for the

6 Pledge of Allegiance.

7 (Whereupon the Pledge of Allegiance

8 was said.)

9 THE CHAIRMAN: I would like to

10 apologize to everyone for the late start

11 to our meeting tonight. One of our

12 members was traveling in from the city,

13 got stuck in a little traffic and that's

14 why we're running a little late tonight.

15 First order of business will be the

16 approval of our minutes from the January

17 9th, 2008 meeting. Is there a motion to

18 approve the minutes?

19 MR. BORDUCCI: So moved.

20 MR. DE MARCO: Second.

21 THE CHAIRMAN: Moved by Mr.

22 Borducci. Second by Mr. De Marco. All

23 in favor.

2 agenda, I would like to introduce to the

3 public our newest member to the board,

4 seated to my immediate right is Mr. Alan

5 Pilla who has agreed to volunteer his

6 time to serve on this Board. I am very

7 happy that Alan has decided to join us.

8 We just a few years ago went to school

9 together. He's an attorney with a local

10 practice in town and I think he will be a

11 tremendous addition to the board. So, I

12 would like to welcome Alan to our board.

13 MR. PILLA: Thank you.

14 THE CHAIRMAN: What we'll do, as we

15 do before every meeting, I'll run through

16 the agenda. For the applicants that are

17 here, please let us know if you intend to

18 proceed tonight so that if there are

19 people in the audience interested in your

20 application or if there are people at

21 home watching for a particular

22 application they will know if we are

23 going to proceed on that application or

24 not tonight.

3 Plains Road. The attorney for the

4 applicant is here.

5 MR. PERISI: Yes.

6 THE CHAIRMAN: Mr. Perisi, right?

7 MR. PERISI: Yes.

8 THE CHAIRMAN: Are you proceeding

9 tonight?

10 MR. PERISI: Yes.

11 THE CHAIRMAN: 600 White Plains

12 Road is going to proceed tonight. We

13 then move to the new business agenda.

14 First application on that is Application

15 07-91, 10 Park Drive. The applicant is

16 here on that. Are you intending to

17 proceed tonight?

18 APPLICANT: Yes.

19 THE CHAIRMAN: The applicant is

20 proceeding on that. Next one is

21 Application 07-96, 68 Lake Shore Drive.

22 Is someone here on that?

23 MS. RIVERA: Yes.

24 THE CHAIRMAN: Are proceeding

25 tonight.

2 MS. RIVERA: Yes.

3 THE CHAIRMAN: That one will be

4 going forward as well. Next one is

5 Application 08-01, 137 Hutchinson

6 Boulevard. Is someone here on that

7 application? Nobody is answering, but

8 from what the building department has

9 been told that is very likely to proceed

10 tonight.

11 Next one is Application 08-14, 490

12 through 498 New Rochelle Road. The

13 attorney for the applicant is here and

14 you plan to proceed, correct?

15 MR. BAUMAN: We plan to proceed.

16 THE CHAIRMAN: That one will

17 proceed tonight as well. Final one on

18 the agenda tonight is Application 08-15,

19 42 Alkamont Avenue. Is somebody here for

20 that? Mr. Cotugno is here for that. And

21 you intend to proceed?

22 MR. COTUGNO: Yes.

23 THE CHAIRMAN: That one will

24 proceed as well. We also have three

25 items that have been adjourned in case

2 anyone is tuning in or here tonight for

3 these applications. The first adjourned

4 application is 31 Stewart Place, that's

5 been adjourned to the April 8th meeting

6 of the Zoning Board. You will not get

7 any other notification through the mail

8 for that meeting, that application, it

9 will appear on our April agenda.

10 The next adjourned application is

11 85 Tuckahoe Avenue, that has also been

12 adjourned to the April 8th meeting of the

13 Zoning Board.

14 The final adjournment tonight is

15 165 Oakland Avenue.

16 So, if anybody at home or anyone

17 here is interested in those three

18 applications or any of them, they will

19 not be proceeding tonight. They will be

20 back in April and you will not receive

21 any additional mailings from the

22 applicant, from the town or any other

23 notification that they're proceeding in

24 April because the way the rules work is

25 once you're on the agenda and you're

2 adjourned to the next month there is no

3 additional notification that is required

4 by the applicant. It's supposed to be

5 the obligation of the public to follow

6 the agenda from month to month to know

7 what is going to be on and what's not on.

8 That's our practice.

9 Okay, we can now proceed to the

10 first item tonight, which is Application

11 07-97, 600 White Plains Road. Mr.

12 Perisi.

13 MR. PERISI: Good evening.

14 THE CHAIRMAN: Good evening.

15 MR. PERISI: May I proceed?

16 THE CHAIRMAN: Absolutely.

17 MR. PERISI: I would just like to

18 address a few of the issues raised since

19 the last Zoning Board meeting that we

20 attended. First, it's my understanding

21 that a group of area residents

22 spearheaded by a disgruntled former

23 tenant to a prior landlord who actually

24 sought to use the property the way we

25 seek to use it has submitted signed
