2 THE CHAIRMAN: I would like to
3 welcome everybody to the special meeting
4 of the Zoning Board of Appeals for June
5 24th. Would everybody please stand for
6 the Pledge of Allegiance.

9 THE CHAIRMAN: Again, I would like
10 to welcome everybody. We're here tonight
11 in order to finalize one application that
12 remained from our meeting two weeks ago,
13 it's application 08-42, 141 Hillside
15 When we left two weeks ago, we
16 requested that our police department
17 conduct a survey of the area around
18 Hillside Place. One was conducted last
19 fall for a different application and they
20 graciously went forward and conducted
21 another one for us and we have the
22 results of the survey from Chief Tim
24 We adjourned the last meeting in
25 order to get an updated survey. We left
2 the public hearing open. So, if anybody
3 from the public would like to speak, they
4 will be allowed to do that tonight, and
5 then hopefully we'll go to a resolution
6 and then resolve this application.
7 Mr. Bauman, would you like to start
8 on behalf of the applicant, then we'll go
9 to the public, then we'll allow Mr.
10 Bauman to have the final word and we'll
11 come back to the board.
12 MR. BAUMAN: Good evening, Mr.
13 Chairman, members of the board. First of
14 all, on behalf of the applicant and
15 myself, personally, I want to thank you
16 for scheduling this only two weeks after
17 the original hearing so that we don't
18 have to go through the summer and wait
19 for the results of this application. The
20 applicants are scheduled, if all goes
21 through, to close some time in July. So,
22 that's why we appreciate your courtesy in
24 I have a very short statement. I
25 would like to be the person to introduce
2 the parking survey that was provided to
3 us by the Eastchester Police and I'll do
4 that as part of this initial statement.
5 The application came on to be heard by
6 this board on June 10th, 2008. Following
7 presentation of the application and after
8 considerable discussion by the board and
9 members of the public had been heard, it
10 was decided to put the application over
11 to this evening in order to obtain from
12 the Eastchester Police Department an
13 updated parking survey indicating the
14 availability of metered and other on
15 street parking, public parking in the
16 immediate vicinity of the subject
17 property, which, of course, is 141
18 Hillside Place in Eastchester.
19 Before this decision was made, the
20 board had read into the record and
21 considered the Eastchester Police
22 Department parking survey which was dated
23 November 7th, 2008 which the chairman
24 tonight just referred to. That report
25 had been prepared for The Faucet Works
2 application on White Plains Road situated
3 in close proximity to the subject
4 property. After describing the available
5 parking in the area concluded, and I
6 quote from that report: As suspected
7 there is no lack of metered parking
8 spaces in the area and the parking
9 overflow from the retail establishments
10 can easily be accommodated by the
11 availability of metered parking.
12 Notwithstanding the conclusion of
13 that survey for this application the
14 board decided to request an updated
15 parking survey from the same area from
16 the police department. We now have that
17 survey and I ask that it be incorporated
18 into this record for consideration by the
19 board. It was faxed to me at the end of
20 the day this afternoon by Margaret Uhle
21 and I would like to, with your
22 permission, read this into the record.
24 MR. BAUMAN: This is a letter from
25 the Eastchester Police Department dated
2 today addressed to Margaret Uhle from
3 Chief Timothy Bonci, reference is parking
4 survey Hillside Place: In regards to
5 your request for a parking survey for the
6 Hillside Place application, we have
7 surveyed the area and below are the
8 findings. One, there is metered parking
9 availability both in the Fisher Avenue
10 municipal lot, approximately fourteen
11 spaces, and on Hillside Place over twenty
12 spaces. Two, observations were made at
13 zero nine hundred hours and fourteen
14 hundred hours during the week and on
15 Saturdays. Three, at all times of the
16 observations there was metered parking
17 available in excess of twelve spaces. In
18 conclusion, as suspected, there was no
19 lack of metered parking spaces in the
20 area and the parking overflow from the
21 office can easily be accommodated by the
22 availability of metered parking. And
23 it's signed, respectfully submitted Chief
25 As I said, I request that report be
2 incorporated into the record.
3 The only other comment I would make
4 at this time would be that I was just
5 informed by Mr. Elefante that he was at
6 the town clerk's office today this
7 afternoon and he was informed that he was
8 going to be provided with a parking
9 permit, so that there is one additional
10 parking permit that this particular
11 applicant will have the use of in the
12 across the street parking.
13 Finally, I was also informed that
14 the second floor dweller also received a
15 parking permit, so his car is also going
16 to be parked in permit parking as opposed
17 to metered parking. So, it just adds two
18 additional potential spaces in the
19 metered area for use by the public.
20 I'll withhold my conclusion until
21 after the public hearing is closed.
