Freedom of Information Law -(FOIL)

The Freedom of Information Law (“FOIL”), Article 6 (Sections 84-90) of the NYS Public Officers Law, provides the public right to access to records maintained by government agencies with certain exceptions.

To request a record, a FOIL Request Form must be completed and submitted to the Town Clerk's Office.

Within five business days of the receipt of the written request, you will be emailed an 'acknowledgement letter.'  It will state if the requested record is available; explain if the request is denied; or furnishing a written acknowledgment of the receipt of such request.  Further, it will provide you with an estimate of when the record(s) will be available. If you have not received notice within five business day, please contact us at 914-771-3351.

If the records you request require a fee to be paid, you will be notified prior to the records being released to you. Public Officers Law §87(1) authorizes an agency to charge a fee of 25¢ per copy for copies of records up to 9"x14", or the actual cost of reproducing a record.

RIGHT TO APPEAL:

Under provisions of the Public Officers Law you may appeal a FOIL determination. If you desire to submit such an appeal, you must do so within 30 days of written response to your FOIL request. Please include a copy of the original request, a copy of the response letter, and your appeal letter to the designated Appeals Officer.  You will be informed of the decision regarding the Appeal within ten business days.

When submitting a FOIL Request:
   - Be as specific as possible in describing the record(s). Include relevant dates, names, descriptions, etc.

   - Specify whether you would like to inspect the records or have copies of the records sent to you.

   - If records are available, specify how your want them sent, ie: Via US mail; email; etc. 

    - Include your email, mailing address and primary contact phone number where you can be reached.

    - Please note that the agency is not required to create a new record in response to FOIL requests.
